Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, HMS/TJ/13/01, HMS/TJ/13/02, HMS/TJ/13/03, HMS/TJ/13/04, HMS/TJ/13/05, HMS/TJ/13/06, HMS/TJ/13/07A, HMS/TJ/13/08A, HMS/TJ/13/09A, HMS/TJ/13/10A, HMS/TJ/13/11A, HMS/TJ/13/12A, HMS/TJ/13/13B, HMS/TJ/13/14B, HMS/TJ/13/15B, HMS/TJ/13/16B, HMS/TJ/13/17A and HMS/TJ/13/18, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The materials to be used in the external construction and finishes of the development hereby permitted shall be in accordance with those submitted with the application or as otherwise agreed in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, G4, D1 and H12 of the South Oxfordshire Local Plan 2011.
Notwithstanding the provisions of the Town and Country (General Permitted Development Order) 1995 (or any Order revoking or re-enacting that Order), no development as specified in Schedule 2, Part 1, Class A - Extensions; Class B - Roof Extensions; Class E - Outbuildings; Class F - Hardstandings shall be undertaken without the prior written permission of the Local Planning Authority.
Reason: The specific circumstances of this site warrant the Local Planning Authority having control over any further development as specified in the condition in the interests of amenity and in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, G4, D1 and H12 of the South Oxfordshire Local Plan 2011.
The dwelling shall achieve Level 4 of the Code for Sustainable Homes. No dwelling shall be occupied until a final Code Certificate has been issued for it certifying that Code Level 4 has been achieved.
Reason: To ensure high standards of sustainable design and construction in accordance with Policy CSQ2 of the South Oxfordshire Core Strategy 2027.
The tree protection measures set out in the tree survey report submitted with the application shall be set in place prior to the commencement of any site works and retained in situ for the duration of the development. The landscaping shown on approved plan HMS/13/TJ/07/A shall be implemented no later than within the first planting season following the occupation of the dwelling hereby approved.
Reason: To ensure that important trees are protected and to assimilate the development into its surroundings in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, G4, D1 and H12 of the South Oxfordshire Local Plan 2011.
The detached gym/steam room and garage hereby permitted shall not be occupied at any time other than for purposes incidental to the residential use of the dwelling known as Hillmorton.
Reason: As the separate occupation of the accommodation would represent an undesirable sub-division of the property and result in inadequate standards of amenity and privacy in accordance with Policies G2 and H12 of the South Oxfordshire Local Plan 2011.
The archaeological watching brief submitted in support of the application shall be maintained during the period of construction/during any groundworks taking place on the site in accordance with the Written Scheme of Investigation that has first been approved in writing by the Local Planning Authority.
Reason: To safeguard the recording and inspection of matters of archaeological importance on the site in accordance with Policy CSEN3 of the South Oxfordshire Core Strategy 2027 and Policies G2, CON11, CON13 and H12 of the South Oxfordshire Local Plan 2011.
