Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 1668/1, 1668/2, 1668/4, 1668/5, BLO-001 and 174-089-100 A, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

That the hours of use of the restaurant shall not exceed 09:00 to midnight on Sundays to Thursdays and 08:00 to 01:00 the following day for Fridays and Saturdays. Reason: To protect the amenity of the adjoining properties in accordance with Policies EP2, TSM1, TSM2 and TSM3 of the South Oxfordshire Local Plan 2011.

That no development shall take place until details of the noise and odour control techniques from the kitchen extraction unit and other mechanical services have been submitted to and approved, in writing, by the Local Planning Authority. Technical details of the kitchen extraction unit should include; - The height of the termination of the extract with reference to the surrounding roof levels - The effective stack height - calculated from the efflux velocity (air speed as it leaves the duct), the wind speed at the top of the stack (based on prevailing weather conditions), and the internal diameter of the stack - The type of odour abatement (eg charcoal filters) - The performance of odour filters - Information regarding the types and quantities of food being prepared. - Vibration damping offered by brackets used to fix the extract units to any walls of residential properties The noise report must be produced in accordance with 'BS:4142 (1997), Method for rating industrial noise affecting mixed residential and industrial areas' and include the following information; - Noise levels produced by the mechanical services at the nearest noise sensitive location - The rating level of the noise - is it tonal or intermittent? - The times of operation of the equipment - The background noise level at the nearest noise sensitive location. Thereafter, the development shall not be carried out other than in accordance with the approved details and any mitigation measures recommended. Reason: To protect the amenity of the adjoining properties in accordance with Policies EP2, TSM1, TSM2 and TSM3 of the South Oxfordshire Local Plan 2011.
