Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 1, E002, 7099/PL004a, 7099/PL005a, 7099/PL006a, 7099/PL010a, 7099/PL012b, 7099/PL015, 7099 PRPL006A, 7099 PRPL007A, 7099/PL011b, 7099/PL001b, 7099/PL008b, 7099/PL009b, 7099/PL010b, 7099/PL002g, 7099/PL003e, 7099/PL013d and 7099/PL016b, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
Prior to the commencement of development detailed plans showing the existing and proposed ground levels of the site together with the slab and ridge levels of the proposed development, relative to a fixed datum point on adjoining land outside of the application site, shall be submitted to and approved in writing by the Local Planning Authority. Thereafter the development shall be carried out in accordance with the approved details.
Reason: To ensure a satisfactory form of development in accordance with Policies CSEN1, CSEN3 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C3, C4, CON5, CON7, D1 and R3 of the South Oxfordshire Local Plan 2011.
Prior to the commencement of the development hereby approved samples of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policies CSEN1, CSEN3 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C3, C4, CON5, CON7, D1 and R3 of the South Oxfordshire Local Plan 2011.
The development hereby permitted shall not be occupied until it can be demonstrated that it has achieved at least a BREEAM Excellent standard.
Reason: To ensure high standards of sustainable design and construction in accordance with Policy CSQ2 of the South Oxfordshire Core Strategy 2027.
The development hereby approved shall be designed and constructed to meet Secure by Design Part 2 Standards for physical security.
Reason: To reduce the opportunity for crime in accordance with Policy D6 of the South Oxfordshire Local Plan 2011.
Prior to the first occupation of the development hereby approved a turning area and car parking spaces shall be provided within the curtilage of the site so that motor vehicles may enter, turn round and leave in a forward direction and vehicles may park off the highway. The turning area and parking spaces shall be constructed, laid out, surfaced, drained and completed to be SUDS compliant in strict accordance with specification details to be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development. The turning area and car parking spaces shall be retained unobstructed except for the parking and manoeuvring of motor vehicles at all times.
Reason: In the interests of highway safety and to ensure the provision of off-street car parking in accordance with Policy CSM1 of the South Oxfordshire Core Strategy 2027 and Policies G2, D2, R3, T1 and T2 of the South Oxfordshire Local Plan 2011.
A Construction Traffic Management Plan (CTMP) shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development. The approved CTMP shall be implemented prior to any works being carried out on site, and shall be maintained throughout the course of the development.
Reason: In the interests of highway safety and to mitigate the impact of construction vehicles on the surrounding highway network, road infrastructure and local residents, particularly at morning and afternoon peak traffic times and in accordance with Policy CSM1 of the South Oxfordshire Core Strategy 2027 and Policies G2, D2, R3, T1 and T2 of the South Oxfordshire Local Plan 2011.
Prior to the use of the development hereby permitted a Green Travel Plan shall be drawn up, and submitted to and approved in writing by the Local Planning Authority; such plans to include proposals for all travel by modes other than the private car for journeys to and from site.
Reason: To promote the use of non car modes of transport in accordance with Policy CSM2 of the South Oxfordshire Core Strategy 2027.
Prior to the commencement of the development hereby permitted a scheme for the landscaping of the site, including the planting of live trees and shrubs, boundary treatment and the treatment of the access road and hard standings, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The hard landscaping scheme shall be implemented as approved prior to the first use of the building. The soft landscaping scheme shall be implemented as approved within 12 months of the first planting season of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in accordance with Policies CSEN1, CSEN3 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C3, C4, C9, CON5, CON7, D1 and R3 of the South Oxfordshire Local Plan 2011.
Prior to the commencement of any site works (including demolition or site clearance) a protected area shall be designated for all existing trees which are shown to be retained, and the trees shall be protected in accordance with an updated tree protection scheme which complies with the current edition of BS 5837: "Trees in relation to design, demolition and construction" that shall first have been submitted to, and approved in writing by, the Local Planning Authority. The updated scheme shall include details of all service runs to be located outside of the retained trees' root protection areas and any associated additional tree protection measures. The agreed measures shall be kept in place during the entire course of development.
Reason: To safeguard trees which are visually important in accordance with Policies CSEN1, CSEN3 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C3, C4, C9, CON5, CON7, D1 and R3 of the South Oxfordshire Local Plan 2011.
The development hereby permitted shall be implemented in accordance with the recommendations contained in chapter 5 of the Extended Phase 1 Habitat Survey report (BSG Ecology, October 2013) submitted with the application in all respects with the exception of further surveys for great crested newts which have been completed. This condition will be discharged on receipt of a letter providing evidence that the mitigation has been completed according to the approved report.
Reason: To protect the important species on the site, in accordance with Policy CSB1 of the South Oxfordshire Core Strategy 2027 and Policies G2, C6, C8 and R3 of the South Oxfordshire Local Plan 2011.
The development hereby permitted shall only be used for leisure purposes by members of Phyllis Court Club and not for any separate leisure or other purposes at any time.
Reason: As the separate use of the building would undermine the vitality and viability of Henley Town Centre and would represent an undesirable sub-division of the premises and result in additional traffic and inadequate standards of amenity and privacy in accordance with Policy CST1 and CSHEN1 of the South Oxfordshire Core Strategy and Policies G2, D4, R3 and T1 of the South Oxfordshire Local Plan 2011.
The operating hours of the premises hereby permitted shall be restricted to the hours of 6am to 10pm Monday to Friday and 8am to 7pm on Saturdays, Sundays and Public Holidays.
Reason: In the interests of the amenities of the occupants of nearby properties and in accordance with Policies G2, EP2, R3 and T1 of the South Oxfordshire Local Plan 2011.
A construction management plan detailing measures to be taken to protect nearby residents from noise and dust shall be submitted to and approved by the Local Planning Authority prior to the commencement of any construction or demolition works. The hours of operation for such works shall be restricted to 8:00 am - 6.00 pm Monday to Friday and 8.00 am - 1.00 pm on a Saturday. No
work shall take place on Sundays or Public Holidays without the prior written authority of the Local Planning Authority.
Reason: To protect the occupants of nearby residential properties from noise and dust disturbance during the development of the site in accordance with Policies G2, EP1, EP2 and R3 of the South Oxfordshire Local Plan 2011.
All plant, machinery and equipment to be used by reason of the granting of this permission shall be installed, maintained and operated so as to ensure that the rating noise level from the equipment does not exceed 5 dBA below the background noise level at the facade of adjoining residential accommodation. Measurement and rating of noise for the purposes of this condition shall be in
accordance with BS4142 (1997) 'Method for rating industrial noise affecting mixed residential and industrial areas'.
Reason: To protect the occupants of nearby residential properties from loss of amenity due to noise disturbance and in accordance with Policies G2, EP1, EP2 and R3 of the South Oxfordshire Local Plan 2011.
External lighting will only be permitted in accordance with a lighting scheme to be approved in writing by the Local Planning Authority. Any such lighting shall be directed downwards to prevent nuisance to adjoining residential occupiers from light spillage and shall be turned on only during the hours of operation and remain off at all other times.
Reason: To safeguard the amenity of neighbouring residents and the rural character of the countryside in accordance with Policies CSEN1, CSEN3 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C3, C4, CON5, CON7, EP3 and R3 of the South Oxfordshire Local Plan 2011.
No development shall take place until a surface water drainage scheme for the site, based on sustainable drainage principles and an assessment of the hydrological and hydro-geological context of the development, has been submitted to and approved in writing by the local planning authority. The drainage strategy should demonstrate the surface water run-off generated up to and including the 1 in 100 year event with a 30% allowance for climate change critical storm will not exceed the run-off from the undeveloped site following the corresponding rainfall event. The scheme shall
subsequently be implemented in accordance with the approved details before the development is completed. The scheme shall also include details of how the scheme shall be maintained and managed after completion.
Reason: To prevent pollution and flooding in accordance with Policies G2, EP1, EP4, EP6 and R3 of the South Oxfordshire Local Plan 2011.
The development hereby permitted shall not be occupied until foul drainage works have been carried out in accordance with details that have been first submitted to and approved in writing by the Local Planning Authority.
Reason: To prevent pollution in accordance with Policies G2, EP1 and R3 of the South Oxfordshire Local Plan 2011.
The hours of use of the floodlighting serving the tennis courts shall be
restricted to between 8.00 am to 9.00 pm.
Reason: To prevent undue light pollution and to protect the amenities of the local area in accordance with Policies CSEN1, CSEN3 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C3, C4, CON5, CON7, EP3 and R3 of the South Oxfordshire Local Plan 2011.
