The use described in the application would not be at a level that is ancillary to the 'aquatic recreation' use of the lakes. The use described would amount to a material change of use. The evidence submitted with the application is not sufficiently precise in line with Circular 10/97 Part 4 Paragraph 1406 and there is evidence to suggest the use was not occurring on the scale and frequency over the relevant period as claimed. As such, on the balance of probability, the use of the land for the 'temporary siting and use of caravans and tents for human habitation ancillary to the recreational use of Queenford Lakes' has not been ongoing for a continuous and uninterrupted period of ten years prior to the application date and cannot therefore be regarded as lawful.
