Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, KCC2, KCC3 and KCC1, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The building shall be used for ancillary purposes in connection with the horticultural business on the site and at no time be used other than for purposes ancillary to or in connection with the principal use of the site as a horticultural business. For the avoidance of doubt the ancillary use does not include retail sales or use as a dwelling.
Reason: This is a location where new buildings are not appropriate unless for an identified need to ensure that the character of the countryside is protected in accordance with Policy CSEN1 of the adopted Core Strategy and Policies G2, G4 and A1 of the South Oxfordshire Local Plan 2011.
That if within 10 years of the substantial completion of the building, the use of the building for horticultural or agricultural purposes permanently ceases, and within a further 3 years, planning permission has not been granted for an alternative use, and there is no outstanding appeal, the building shall be dismantled, the materials shall be removed from the land and the land restored to its former condition before development took place, or to such a condition as shall otherwise have been agreed in writing by the Local Planning Authority.
Reason: To safeguard the character of the area in accordance with Policy A1 of the South Oxfordshire Local Plan 2011.
