Conditions / Refusal Reasons
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans,13/350/01 and 13/350/01a, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

The development hereby approved shall only be constructed in the materials specified on the approved plans and as specified in the application. Reason: In the interests of the appearance of the development and to safeguard the character of the area, in accordance with policies C4 and D1 of the South Oxfordshire Local Plan 2011 and policy CSEN1 of the Core Strategy.

Any gates provided shall be set back a minimum of 9.0 metres from the edge of the carriageway and shall open inwards into the site. Reason: To ensure that vehicles may wait clear of the highway while the gates are opened or closed in the interests of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.

With the exception of the wild cherry tree shown to be removed on the approved plans, the existing trees and hedges on the land shall be protected whilst development operations are in progress in accordance with a scheme to be submitted to and approved in writing by the Local Planning Authority prior to the commencement of works to create the gravel splay and to widen the gates. The agreed scheme shall be kept in place during the entire course of the development hereby permitted. Reason: To safeguard trees and hedges which are visually important in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011.

A scheme for the landscaping of the site, including the planting of live trees, shall be submitted to and approved in writing by the Local Planning Authority prior to the laying of the gravel surface to the access and track-way. The scheme shall be implemented as approved prior to the first use of the access other than by construction vehicles following the date of this permission and shall thereafter be maintained in accordance with the approved scheme. In the event of any of the trees so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or equivalent number of trees, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help assimilate the development into its surroundings in accordance with policies R10 and C9 of the South Oxfordshire Local Plan 2011 and policy CSEN1 of the South Oxfordshire Core Strategy 2027.

The access and track-way hereby permitted shall be used only for agriculture or for the private leisure equestrian purposes of the owner of the land, and shall not be used for any commercial activity. Reason: To meet the particular needs of the applicant and to avoid the introduction of a commercial use in this rural location, in accordance with Policies CSS1 and CSEN1 of the South Oxfordshire Core Strategy 2027 and Policies G2, and R10 of the South Oxfordshire Local Plan 2011.

That no lighting shall be installed unless it has previously been approved in writing by the local planning authority. Reason: To safeguard the amenity of neighbouring residents and the rural character of the countryside and the Chilterns Area of Outstanding Natural Beauty, in accordance with Policy CSEN1 of the South Oxfordshire Core Strategy 2027 and Policies G2,EP3 and R10 of the South Oxfordshire Local Plan 2011.
