Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, HMS/TJ/13/01, HMS/TJ/13/02, HMS/TJ/13/04, HMS/TJ/13/05, HMS/TJ/13/06, HMS/TJ/13/07, HMS/TJ/13/08, HMS/TJ/13/09, HMS/TJ/13/10, HMS/TJ/13/11, HMS/TJ/13/12, HMS/TJ/13/13, HMS/TJ/13/14, HMS/TJ/13/15, HMS/TJ/13/16, HMS/TJ/13/17 and HMS/TJ/13/18, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

Prior to the commencement of development detailed plans showing the existing and proposed ground levels of the site together with the slab and ridge levels of the proposed development, relative to a fixed datum point on adjoining land outside of the application site, shall be submitted to and approved in writing by the Local Planning Authority. Thereafter the development shall be carried out in accordance with the approved details. Reason: To ensure a satisfactory form of development in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, G4, D1 and H12 of the South Oxfordshire Local Plan 2011.

Prior to the commencement of the development hereby approved a schedule of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, G4, D1 and H12 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country (General Permitted Development Order) 1995 (or any Order revoking or re-enacting that Order), no development as specified in Schedule 2, Part 1, Class A - Extensions; Class B - Roof Extensions; Class E - Outbuildings; Class F - Hardstandings shall be undertaken without the prior written permission of the Local Planning Authority. Reason: The specific circumstances of this site warrant the Local Planning Authority having control over any further development as specified in the condition in the interests of amenity and in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, G4, D1 and H12 of the South Oxfordshire Local Plan 2011.

The dwelling(s) shall achieve Level 4 of the Code for Sustainable Homes. No dwelling shall be occupied until a final Code Certificate has been issued for it certifying that Code Level 4 has been achieved. Reason: To ensure high standards of sustainable design and construction in accordance with Policy CSQ2 of the South Oxfordshire Core Strategy 2027.

The tree protection measures set out in the tree survey report submitted with the application shall be set in place prior to the commencement of any site works and retained in situ for the duration of the development. The landscaping shown on approved plan HMS/13/TJ/07 shall be implemented no later than within the first planting season following the occupation of the dwelling hereby approved. Reason: To ensure that important trees are protected in accordance with Policy CSEN1 of the South Oxfordshire Core Strategy 2027 and Policies G2, G4, D1 and H12 of the South Oxfordshire Local Plan 2011.

The detached gym/steam room and garage hereby permitted shall not be occupied at any time other than for purposes incidental to the residential use of the dwelling known as Hillmorton. Reason: As the separate occupation of the accommodation would represent an undesirable sub-division of the property and result in inadequate standards of amenity and privacy in accordance with Policies G2 and H12 of the South Oxfordshire Local Plan 2011.

The applicant,or their agents or successors in title, shall be responsible for organising and implementing an archaeological watching brief, to be maintained during the period of construction/during any groundworks taking place on the site. The watching brief shall be carried out by a professional archaeological organisation in accordance with a Written Scheme of Investigation that has first been approved in writing by the Local Planning Authority. Reason: To safeguard the recording and inspection of matters of archaeological importance on the site in accordance with Policy CSEN3 of the South Oxfordshire Core Strategy 2027 and Policies G2, CON11, CON13 and H12 of the South Oxfordshire Local Plan 2011.

Following the approval of the Written Scheme of Investigation referred to in condition 1, no development shall commence on site without the appointed archaeologist being present. Once the watching brief has been completed its findings shall be reported to the Local Planning Authority, as agreed in the Written Scheme of Investigation, including all processing, research and analysis necessary to produce an accessible anduseable archive and a full report for publication. Reason: To safeguard the recording and inspection of matters of archaeological importance on the site in accordance with Policy CSEN3 of the South Oxfordshire Core Strategy 2027 and Policies G2, CON11, CON13 and H12 of the South Oxfordshire Local Plan 2011.
