Conditions / Refusal Reasons
The application site lies within a loose knit area of residential development in an elevated position within the Chilterns Area of Outstanding Natural Beauty. The proposed replacement dwelling, due to its size, height, siting and bulk, would be visually intrusive in the landscape and would have a materially greater visual impact on the character and appearance of the site and the surrounding area compared to the existing dwelling, including the extant planning permission for its enlargement. As such the development would fail to respect the rural character and appearance of the surrounding area and the landscape qualities of the Chilterns Area of Outstanding Natural Beauty, and the development would therefore be contrary to Policies CSQ3 and CSEN1 of the South Oxfordshire Core Strategy and Policies G2, G4, C4, D1 and H12 of the South Oxfordshire Local Plan 2011 and guidance contained within the National Planning Policy Framework.
Compared to the existing relationship between Marigay and Whistling Cottage, the proposed development, due to the siting, size, height and bulk of the dwelling, would have an unduly dominating presence on the outlook from the private garden area and rear elevation of the neighbouring property, Whistling Cottage, to the detriment of the amenity currently enjoyed by the occupiers of this property. As such the proposal would be contrary to Policies G2, D1, D4 and H12 of the South Oxfordshire Local Plan 2011.
