Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 2580, 2974 50A, 2974 01C, 2974 02D, 2974 03C and 2974 03D Drainage Plan, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The slab levels and ridge heights of the proposed dwelling, shall be implemented as shown on the approved plan 2974/03D and thereafter retained as such.
Reason: To ensure that the development properly relates to the levels of adjoining development in the interests of amenity and in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy and Policies G2, C4, D1, D4 and H12 of the South Oxfordshire Local Plan 2011.
The exterior of the dwelling hereby permitted shall only be constructed in Contessa slate tile, Aldwick blend bricks in Flemish bond and solid timber window frames painted Dulux Chiltern White or in materials which shall previously have been approved in writing by the Local Planning Authority.
Reason: In the interests of the appearance of the development and in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy and Policies G2, C4, D1, D4 and H12 of the South Oxfordshire Local Plan 2011.
Notwithstanding the provisions of the Town and Country (General Permitted Development Order) 1995 (or any Order revoking or re-enacting that Order), no development as specified in Schedule 2, Part 1, Class A (Extensions), Class C (Rooflights), Class D (Porch), Class E (Outbuildings) and Class F (Hardstandings) shall be undertaken without the prior written permission of the Local Planning Authority.
Reason: The specific circumstances of this site warrant the Local Planning Authority having control over any further development as specified in the condition in the interests of amenity and in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy and Policies G2, C4, C9, D1, D4 and H12 of the South Oxfordshire Local Plan 2011.
The measures set out in the Sustainable Design Statement which accompanied application P12/S0464, in respect of sustainable building, shall be implemented in accordance with the statement prior to the first occupation of the dwelling, unless as may otherwise be agreed in writing by the Local Planning Authority.
Reason: To ensure sustainable development in accordance with Policy CSQ2 of the South Oxfordshire Core Strategy.
The refuse and recycling storage for the approved dwelling shall be implemented as shown on the approved plan 2974/03D and thereafter retained as such.
Reason: To ensure adequate provision for the management of waste in accordance with Policy CSQ2 of the South Oxfordshire Core Strategy and Policies G2, D10 and H12 of the South Oxfordshire Local Plan 2011.
The landscaping of the site shall be implemented as shown on the approved plan 2974/03D and thereafter retained as such. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy and Policies G2, C4, C9, D1 and H12 of the South Oxfordshire Local Plan 2011.
The development hereby permitted shall be implemented in accordance with the mitigation proposals illustrated on drawings 2580 SK10 and 2580 SK11 and the measures outlined in the two bat reports in all respects. Any variation shall be agreed in writing by the Local Planning Authority before such change is made.
Reason: To protect the important species on the site, in accordance with Policies G2, C8 and H12 of the South Oxfordshire Local Plan 2011
The development shall be carried out in accordance with the Archaeological Watching Brief previously agreed with Oxfordshire County Council.
Reason: To secure the protection of and proper provision for any archaeological remains in accordance with Policies G2, CON11, CON13, CON14 and H12 of the South Oxfordshire Local Plan 2011.
