Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004. Related application(s): P16/S2100/DIS, P16/S2300/DIS

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, C142-10B, FMCP-3, FMCP-4, SURV 7811/1, C142-12B, C142-11B, C142-01, 3909-D, DWG-SO-SP1 and DWG-SO-FP1, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

Prior to the commencement of the development hereby approved samples of all materials to be used in the external construction and finishes of the gearing enclosure hereby permitted shall be submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2 and D1 of the South Oxfordshire Local Plan 2011.

The development hereby permitted shall be carried out in accordance with the mitigation measures highlighted in the noise report from Sound Solutions (ref: 18559 R1 - dated 08/04/14). Reason: To ensure that the proposed development does not have an adverse effect on the occupiers of neighbouring properties in accordance with Policies G2 and EP2 of the South Oxfordshire Local Plan 2011.

That a scheme for the landscaping of the site, including the planting of live trees and shrubs, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011.

Prior to the commencement of any site works (including demolition or site clearance) the tree protection measures detailed in the arboricultural report from Hayden's Arboricultural Consultants (ref: 3909 - dated 20/01/14) and shown on accompanying drawing no. 3909-D shall be provided on site. The measures shall be kept in place during the entire course of development. Reason: To safeguard trees which are visually important in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011.

The development permitted by this planning permission shall only be carried out in accordance with the approved Flood Risk Assessment (FRA) eWaterpower, 17 September 2014 and the following mitigation measures detailed within the FRA: · An automatic shut off gate shall prevent flow passing down the screw channel when lower water levels exceed 34.65maODN. · Sections of the access path shall be set at existing ground level. The mitigation measures shall be fully implemented prior to the first operation of the facility hereby approved and subsequently in accordance with the timing / phasing arrangements embodied within the scheme, or within any other period as may subsequently be agreed, in writing, by the local planning authority. Reason: To prevent flooding elsewhere by avoiding the alteration of flood flows in accordance with policy G2 of the South Oxfordshire Local Plan 2011 and the guidance in the National Planning Policy Framework.

The development hereby permitted shall not be commenced until a scheme to ensure access is maintained during and after construction for Environment Agency staff to all infrastructure and assets associated with the safe and efficient operation of Sonning Lock and weirs has been submitted to, and approved in writing by, the local planning authority, in consultation with the Environment Agency. The scheme shall be fully implemented and subsequently maintained, in accordance with the timing / phasing arrangements embodied within the scheme, or within any other period as may subsequently be agreed, in writing, by the local planning authority, in consultation with the Environment Agency. Reason: To ensure the safe and efficient operation of river control structures thereby reducing the risk of flooding and maintaining navigation on the river in accordance with policy G2 of the South Oxfordshire Local Plan 2011 and the guidance in the National Planning Policy Framework.

Prior to the commencement of the development hereby approved further ecological surveys shall be carried out and details including an assessment of the impact of the proposed development and any necessary mitigation measures shall be submitted to and approved in writing by the Local Planning Authority. Any subsequent mitigation shall be undertaken in accordance with the findings of the assessment. The surveys shall cover: · The presence of Otters - in particular permanent places of rest · Bats - in particular their presence in trees to be felled. Reason: To ensure there is no adverse effect on biodiversity interests in accordance with Policy CSB1 of the South Oxfordshire Core Strategy 2027 and Policies C6 and C8 of the South Oxfordshire Local Plan 2011.

External lighting will only be permitted in accordance with a lighting scheme to be approved in writing by the Local Planning Authority. Reason: To safeguard the amenity of neighbouring residents and the rural character of the countryside in accordance with Policies G2 and EP3 of the South Oxfordshire Local Plan 2011.
