Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, LOC-001, BLO-001 and 244/0001, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

That the hours of use of the restaurant shall not exceed 09:00 to midnight on Sundays to Thursdays and 09:00 to 02:00 the following day for Fridays and Saturdays. Reason: In the interests of the amenities of the occupants of nearby properties and in accordance with Policies G2 and EP2 of the South Oxfordshire Local Plan 2011.

Prior to the first operation of the extended hours hereby permitted, a lobby shall be erected around the existing main entrance, to ensure one door can remain closed at all times. The lobby shall be constructed, installed and used in accordance with the recommendations detailed in section 7.2 of the acoustic report prepared by Clement Acoustics, ref 8076-NIA-01 RevA, dated 9 May 2013. Reason: To protect the occupants of nearby residential properties from loss of amenity due to noise disturbance and in accordance with Policies G2 and EP2 of the South Oxfordshire Local Plan 2011.

If music other than background music is to be played at the premises, a sound limiting device shall be fitted to the amplification system. The details of the sound limiting device (including the level of the device and access restrictions to prevent tampering) shall be submitted to and approved in writing by the Local Planning Authority before any amplified music is played. No additional sound generating equipment shall be used on the premises without being routed through the sound limiting device. Reason: To protect the occupants of nearby residential properties from loss of amenity due to noise disturbance and in accordance with Policies G2 and EP2 of the South Oxfordshire Local Plan 2011.
