Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 13001.1.220, 13001.100, 13001.110, 13001.120 and 13001.1.210 Rev b, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

The garage accommodation forming part of the development shall be retained for parking motor vehicles at all times and shall not be adapted to be used for any other purpose. Reason: In the interests of highway safety and to ensure the provision of adequate off-street car parking in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan 2011.

That the premises shall only be open between the hours of 9am and 10pm on any day. Reason: To protect the occupants of nearby residential properties from noise and disturbane in accordance with Policy EP2 of the South Oxfordshire Local Plan 2011.

The takeaway premises hereby approved shall not commence trading until the extraction system which incorporates a carbon filter and which was shown on plan ref 13001.1.210 and detailed in the letter dated 25 March from Asset Max Ltd has been installed and is in operation. Thereafter, the development shall not be carried out other than in accordance with the approved details. Reason: To protect the occupants of nearby residential properties/businesses from noise and odour disturbance in accordance with South Oxfordshire Local Plan Policy EP1.

The takeaway premises hereby approved shall not commence trading until the noise mitigation measures as set down in paragraph 6.1 and Appendix 8 of the Noise Impact Assessment in accordance with BS 4142:1997 dated 4 December, 2013 by Sound Planning have been implemented and thereafter the development shall not be carried out other than in accordance with the approved detail. Reason: To protect the nearby residential properties/businesses from noise disturbance in accordance with South Oxfordshire Local Plan Policy EP1.
