That a scheme for the landscaping of the site, including the planting of live trees and shrubs, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011.
No development shall take place until a method statement/construction environmental management plan that is in accordance with the approach outlined in the Planning/Environmental Statement, has been submitted to and approved in writing by the Environment Agency and local planning authority. This shall deal with the creation of the new channel, digging in of the old channel, installation of the culvert and their aftercare and maintenance as well as a plan detailing the works to be carried outshowing how the environment will be protected during the works. Such a scheme shall include details of the following:
- Detailed drawings of the new channel including dimensions of the low flow/highflow channels, bank materials and planting scheme
- The timing of the works
- The measures to be used during the development in order to minimise environmental impact of the works (considering both potential disturbance and pollution)
- The ecological enhancements as mitigation for the loss of brook habitat resultingfrom the development
- A map or plan showing habitat areas to be specifically protected during theworks.
- Any necessary mitigation for protected species (the brook is an important browntrout stream)
- Construction methods
- Any necessary pollution protection methods
- Information on the persons/bodies responsible for particular activities associatedwith the method statement that demonstrate they are qualified for the activitythey are undertaking.
The works shall be carried out in accordance with the approved method statement.
Reason: To protect the watercourse, wildlife and supporting habitat and secure opportunities for the enhancement of the nature conservation value of the site inin accordance with Policy C8 of the South Oxfordshire Local Plan 2011.
No development (or stage in development as may be agreed in writing with the Local Planning Authority), shall take place until a scheme that includes the following components to deal with the risks associated with contamination of the site shall each be submitted to and approved, in writing, by the local planning authority:
1) A site investigation scheme, based on (BRD, BP Service station, Thame Road, Stadhampton, April 2007, 210711/OR1) to provide information for a detailed assessment of the risk to all receptors that may be affected, including those off site.
2) An options appraisal and remediation strategy based on the results of the site investigation and detailed risk assessment referred to in (1). This must give full details of the remediation measures required and how they are to be undertaken.
3) A verification plan providing details of the data that will be collected in order to demonstrate that the works set out in the remediation strategy in (2) are complete and identifying any requirements for longer-term monitoring of pollutant linkages, maintenance and arrangements for contingency action.
Any changes to these components require the express written consent of the local planning authority. The scheme shall be implemented as approved.
Reason: To ensure that risks from land contamination to future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors in accordance with Policy EP8 of the South Oxfordshire Local Plan 2011.
No occupation of each phase of development shall take place until a verification report demonstrating completion of works set out in the approved remediation strategy and the effectiveness of the remediation shall be submitted to and approved, in writing, by the local planning authority. The report shall include results of sampling and monitoring carried out in accordance with the approved verification plan to demonstrate that the site remediation criteria have been met. It shall also include any plan (a "long-term monitoring and maintenance plan") for longer-term monitoring of pollutant linkages, maintenance and arrangements for contingency action, as identified in the verification plan. The long-term monitoring and maintenance plan shall be implemented as approved.
Reason: To ensure that contamination at the site is remediate, such that the site does not pose a threat to controlled waters in accordance with Policy EP8 of the South Oxfordshire Local Plan 2011.
If, during development, contamination not previously identified is found to be present at the site then no further development (unless otherwise agreed in writing with the local planning authority) shall be carried out until the developer has submitted a remediation strategy to the local planning authority detailing how this unsuspected contamination shall be dealt with and obtained written approval from the local planning authority. The remediation strategy shall be implemented as approved.
Reason: To ensure that any unexpected contamination encountered during the developments is suitable assessed and dealt with, such that it does not pose a unacceptable risk to ground or surface water in accordance with Policy EP8 of the South Oxfordshire Local Plan 2011.
