The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004. Related application(s): P13/S0737/DIS

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, BK-1568-1-R5, BK-1568-2-R5, BK-1568-3-R5, BK-1568-4-R5, BK-1568-5-R3, BK-1568-6-R4, BK-1568-7-R6, BK-1568-10-R1, BK-1568-8-R7 and BK-1568-9-R5, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

The exterior of the development hereby permitted shall only be constructed in the materials specified on the plans hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority. Reason: In the interests of the appearance of the development and in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy and Policies G2, G4, D1 and A1 of the South Oxfordshire Local Plan 2011.

Prior to the commencement of development samples of all materials to be used in the access surfacing and kerbing of the development hereby permitted shall be submitted to and approved in writing by the local planning authority. Reason: To safeguard the character of the area in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy and Policies G2, G4, D1 and A1 of the South Oxfordshire Local Plan 2011.

Prior to the first use of the grain store hereby permitted the proposed means of access onto B4009 Britwell Road is to be formed and laid out and constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken. Reason: In the interest of highway safety in accordance with Policies CSM1 of the South Oxfordshire Core Strategy and Policies G2, A1 and T1 of the South Oxfordshire Local Plan 2011.

Prior to the first use of the grain store hereby approved vision splays measuring 4.5 metres x 215 metres shall be provided to each side of the access. Reason: In the interest of highway safety and in accordance with Policy CSM1 of the South Oxfordshire Core Strategy and Policies G2, A1 and T1 of the South Oxfordshire Local Plan 2011.

Prior to the first use of the approved grain store, the parking and turning areas in the form of the concrete apron shall be provided in accordance with the approved plan BK/1568/7/R6 and shall be constructed, laid out, surfaced (bound material), drained and completed, and shall be retained unobstructed. Reason: In the interests of highway safety and in accordance with Policies CSM1 of the South Oxfordshire Core Strategy and Policies G2, D2, A1, T1 and T2 of the South Oxfordshire Local Plan 2011.

No surface water from the development shall be discharged onto the adjoining highway and a scheme to prevent this occurrence shall be submitted to and approved in writing by the Local Planning Authority and constructed prior to the first use of the approved grain store. Reason: In the interests of highway safety and in accordance with Policy CSM1 of the South Oxfordshire Core Strategy and Policies G2, EP6, A1 and T1 of the South Oxfordshire Local Plan 2011.

Any gates provided shall be set back a minimum of 15.0 metres from the edge of the carriageway and shall open inwards into the site. Reason: To ensure that vehicles may wait clear of the highway while the gates are opened or closed in the interests of highway safety and in accordance with Policies CSM1 of the South Oxfordshire Core Strategy and Policies G2, A1 and T1 of the South Oxfordshire Local Plan 2011.

The hard landscaping scheme approved in the Landscape Proposals Tree Protection & Soil Handling Strategy November 2012 as updated by an Addendum January 2013, shall be implemented prior to the first use of the approved grain store. The tree protection measures approved in the strategy shall be put in place prior to the commencement of any site works and retained in situ for the duration of the development. The soft landscaping scheme shall be implemented as approved within the first planting season following the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy and Policies G2, G4, C9 and A1 of the South Oxfordshire Local Plan 2011.

The use of the building hereby permitted shall be limited solely to agricultural purposes in connection with the agricultural use of the land as shown on the plans accompanying the application. Reason: To restrict the use of the building to one compatible with the surrounding rural area in accordance with Policy CSEN1 of the South Oxfordshire Core Strategy and Policies G2, G4 and A1 of the South Oxfordshire Local Plan 2011.

That if within 10 years of the substantial completion of the building, the use of the building for agricultural purposes permanently ceases, and within a further 3 years, planning permission has not been granted for an alternative use, and there is no current appeal, the building shall be dismantled, the materials shall be removed from the land and the land restored to its former condition before development took place, or to such a condition as shall otherwise have been agreed in writing by the Local Planning Authority. Reason: To safeguard the character of the area in accordance with Policy CSEN1 of the South Oxfordshire Core Strategy Policies G2, G4 and A1 of the South Oxfordshire Local Plan 2011.

All plant, machinery and equipment to be used by reason of the granting of this permission shall be installed, maintained and operated in accordance with the details specified in the acoustic report prepared by Paragon Acoustic Consultants (ref 2652_ENA_5, dated 27 November 2012). The construction and structure of the building shall include all those noise mitigation measures specified in Table 5 of the report. Reason: To protect the occupants of nearby residential properties from loss of amenity due to noise disturbance and in accordance with Policies G2, EP2 and A1 of the South Oxfordshire Local Plan 2011.

All plant, machinery and equipment to be used by reason of the granting of this permission shall be so installed, maintained and operated so as to ensure that the noise level from the equipment does not exceed 25 dBA at the boundary of the nearest residential properties. Measurement should be undertaken in accordance with BS4142 (1997) 'Method for rating industrial noise affecting mixed residential and industrial areas' (excepting all references to rating and assessment methods, due to the low background levels experienced in the area). Reason: To protect the occupants of nearby residential properties from loss of amenity due to noise disturbance and in accordance with Policies G2, EP2 and A1 of the South Oxfordshire Local Plan 2011.

External lighting will only be permitted in accordance with a detailed lighting scheme to be submitted to and approved in writing by the Local Planning Authority. Any such lighting shall be directed downwards to minimise light spillage into the surrounding countryside and shall be turned off when the building is left unoccupied. Reason: To safeguard the rural character of the countryside in accordance with Policy CSEN1 of the South Oxfordshire Core Strategy and Policies G2, G4, EP3 and A1 of the South Oxfordshire Local Plan 2011.

The development to which this permission relates shall not be exercised in addition to or in combination with any part of the development permitted under reference P11/S0092. Accordingly, this permission shall be alternative to the previous permission so that either, but not both, may be implemented. Reason: To prevent an inappropriate development of the site by the implementation or partial implementation of both permissions in accordance with Policy CSEN1 of the South Oxfordshire Core Strategy of Policies G2, G4 and A1 of the South Oxfordshire Local Plan 2011.
