Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 198B, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

The following details of the noise and odour control techniques from the kitchen extraction unit and any other mechanical services shall be submitted to and approved in writing by the Local Planning Authority before any works are carried out: Technical details of the kitchen extraction unit should include: i)The height of the termination of the extract with reference to the surrounding roof levels ii)The effective stack height - calculated from the efflux velocity (air speed as it leaves the duct) the wind speed at the top of the stack ( based on prevailing weather conditions) and the internal diameter of the stack iii) The type of odour abatement iv) The performance of odour filters v) Information regarding the types and quantities of food being prepared. It is recommended that the applicant refer to the Defra "Guidance on the Control of Odour and Noise from Commercial Kitchen Exhaust Systems" ( January 2006) for further information. This guide can be located at www.defra.gov.uk/envrionment/noiseresearch/kitchenexhaust/index.htm In accordance with policy EP1 of the adopted South Oxfordshire Local Plan. Reason: To protect the occupants of nearby residential properties from noise disturbance and smells in accordance with Policies EP1 and EP2 of the South Oxfordshire Local Plan 2011.

A noise report shall be provided prior to the first use of the premises in accordance with "BS 4142 (1997), Method for rating industrial noise affecting mixed residential and industrial areas" and include the following information: i) Noise levels produced by the mechanical services at the nearest noise sensitive location ii) The rating level of the noise- tonal or intermittent? iii) The times of operation of the equipment iv) The background noise level at the nearest noise sensitive location The acoustic report shall be prepared by a competent person with a detailed knowledge of acoustics. It is recommended that an acoustic consultant qualified ( as a minimum) to be an associate member of the Institute of Acoustics carry out this survey. In accordance with policy EP2 of the adopted South Oxfordshire Local Plan. Reason: To protect the occupants of nearby residential properties from noise disturbance in accordance with Policy EP2 of the South Oxfordshire Local Plan 2011.

That the premises shall only be open between the hours of 9am to 11pm on any day. Reason: To protect the occupants of nearby residential properties from noise disturbance in accordance with Policy EP2 of the South Oxfordshire Local Plan 2011.
