Refurbishment and part change of use of former Waitrose unit to provide a mixed-use development (Class A1, A3 and C3) including 7no. residential units at first floor, demolition and replacement of facades on south and east elevations, revised car parking arrangements, hard and soft landscaping and associated works to existing building and site layout. Additional information received from the Agent dated 11th October 2012.
Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, (10)002C, (D)001E, (10)101B, (1))102B, (D)101G, (D)102E, (D)103B, (10)204C, (10)205C, (10)004B, (D)003, (10)202C, (10)003B, (D)002K, (10)201C, (10)203C, (10)001D, (10)005B, (D)004F, (10)111B and (10)206C, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
Prior to the commencement of development samples of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority.
Reason: To safeguard the character of the area in accordance with Policy D1 of the South Oxfordshire Local Plan 2011.
That notwithstanding any indication given on the plan, the new brick panels shall be constructed using flemish bond.

The developer shall ensure that appropriate provision is made for the control of dust emanating from the site, so as not to cause undue disturbance to the occupants of nearby residential properties.
Reason: To ensure satisfactory standards of air quality in accordance with Policy EP1 of the South Oxfordshire Local Plan 2011.
The hours of operation for construction and demolition works shall be restricted to 08:00-18:00 Monday to Friday and 08:00-13:00 on a Saturday. No work to take place on Sundays or Public Holidays without the prior written authority of the Local Planning Authority.
Reason: To protect the occupants of nearby residential properties from noise disturbance in accordance with Policy EP2 of the South Oxfordshire Local Plan 2011.
A Construction Traffic Management Plan (CTMP) will be required to be submitted for approval and the approved CTMP shall be implemented prior to any works being carried out on site.
Reason: In the interests of highway safety and to mitigate the impact of construction vehicles on the surrounding highway network, road infrastructure and local residents, particularly at morning and afternoon peak traffic times and in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.
Measures shall be designed, constructed and maintained to protect the residents of the development from the external noise environment to ensure that the indoor ambient noise levels do not exceed the 'good' values as detailed in Table 5 of BS 8233:1999 "Sound insulation and noise reduction for buildings - Code of practice".

No development shall take place within any individual commercial premises preparing food until technical details of any kitchen extraction systems regarding odour control have been been submitted to and approved in writing, by the Local Planning Authority. This information should include;
* The height of the termination of the extract with reference to the surrounding roof levels,
* The effective stack height - calculated from the efflux velocity (air speed as it leaves the duct), the wind speed at the top of the stack (based on prevailing weather conditions), and the internal diameter of the stack.
* The type of odour abatement (charcoal filters etc)
* The performance of odour filters.
* Information regarding noise levels associated with all external plant
* Information regarding the types and quantities of food being prepared.
Reason: To protect the occupants of nearby residential properties/Businesses from noise and odour disturbance from the site in accordance with South Oxfordshire Local Plan 2011 Policy EP1 - Prevention of Polluting Emissions.
The development hereby permitted shall not commence until surface water drainage works have been carried out in accordance with details that have been submitted to and approved in writing by the Local Planning Authority.
Reason: To prevent pollution and flooding in accordance with Policies EP1, EP4 and EP6 of the South Oxfordshire Local Plan 2011.

The applicant, or their agents or successors in title, shall be responsible for organising and implementing an archaeological watching brief, to be maintained during the period of construction/during any groundworks taking place on the site. The watching brief shall be carried out by a professional archaeological organisation in accordance with a Written Scheme of Investigation that has first been approved in writing by the Local Planning Authority.
Reason: To safeguard the recording and inspection of matters of archaeological importance on the site in accordance with the National Planning Policy Framework (NPPF 2012)and Policy CON 12 of the South Oxfordshire Local Plan 2011.
Following the approval of the Written Scheme of Investigation referred to in condition 12 , no development shall commence on site without the appointed archaeologist being present. Once the watching brief has been completed its findings shall be reported to the Local Planning Authority, as agreed in the Written Scheme of Investigation, including all processing, research and analysis necessary to produce an accessible and useable archive and a full report for publication.
Reason: To safeguard the recording and inspection of matters of archaeological importance on the site in accordance with the National Planning Policy Framework (NPPF 2012) and Policy CON12 of the South Oxfordshire Local Plan 2011.
That no more than two of the units may be used for A3 use without a further planning permission in that behalf being submitted to and approved in writing by the Local Planning Authority.
Reason: To ensure the continued viabitity and vitality of the town centre in accordance with Policy TC8 of the South Oxfordshire Local Plan 2011.
