Conditions / Refusal Reasons
The proposed garage, by reason of its forward position in relation to The Wish and adjacent dwellings, would be in close proximity to the street frontage and would represent an unduly dominant building in the street scene, in a sensitive area adjacent to the Rotherfield Peppard Conservation Area and opposite common land within the Chilterns AONB. As such, the proposal would be contrary to Policies G2, G6, C2, CON7, CON16, D1, D2 and H13 of the South Oxfordshire Local Plan 2011, emerging Core Strategy Policies CSEN1 and CSQ3 and advice contained within the South Oxfordshire Design Guide 2008.
The proposed garage, by reason of its location within the root protection area of an adjacent Horse Chestnut tree, would adversely affect the roots of this important tree, which would compromise its longevity within the Rotherfield Peppard Conservation Area. As such, the proposal would be contrary to Policies C1, C2, C9, CON7 and H13 of the South Oxfordshire Local Plan 2011, BS 5837, 2012 and advice contained within the South Oxfordshire Design Guide 2008 and the supporting Trees and Development best practice guidance.
