Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 2569-07, 2569-01, 2569-04, 2569-03, 2569-02, 2569-05 and 2569-06, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

That prior to the first use of the building for A4 purposes, the noise and odour control techniques from the kitchen extraction unit and other mechanical services shall be implemented as approved under planning permission P09/E0720 and shall be so retained and maintained. Reason: To protect the amenity of the adjoining properties in accordance with Policies EP1, EP2, TC1, TSM2 and TSM3 of the South Oxfordshire Local Plan 2011.

That prior to the first use of the building for A4 purposes, the details of how noise from the building will be controlled shall be implemented in accordance with the details approved under planning permission P09/E0720, and shall be so retained and maintained. Reason: To protect the amenity of the adjoining properties in accordance with Policies EP2, TC1, TSM2 and TSM3 of the South Oxfordshire Local Plan 2011.

That prior to the first use of the building for A4 purposes, the waste and recycling facilities, as shown on the approved plans, shall be provided and shall be so retained and maintained. Reason: To ensure adequate provision for the management of waste in accordance with Policy D10 of the South Oxfordshire Local Plan 2011.

That no deliveries or collections by trade vehicles shall take place after 18:00 or before 08:00 on any day. Reason: To protect the amenity of the adjoining properties in accordance with Policies EP2, TC1, TSM2 and TSM3 of the South Oxfordshire Local Plan 2011.

That the hours that the premises are open to the public shall not exceed 11:00 to 23:30 on Mondays to Thursdays, 11:00 to 00:30 the following day for Fridays and Saturdays and 11:00 to 23:00 on Sundays. Reason: To protect the amenity of the adjoining properties in accordance with Policies EP2, TC1, TSM1, TSM2 and TSM3 of the South Oxfordshire Local Plan 2011.

That no waste or re-cycled materials shall be deposited in outside receptacles after 18:00 or before 08:00 on any day. Reason: To protect the amenity of the adjoining properties in accordance with Policies EP2, TC1, TSM2 and TSM3 of the South Oxfordshire Local Plan 2011.

Lighting shall be designed and implemented so that upon completion of the development, the lighting shall be installed so the main beam angle is not directed towards any potential observers. The lighting sources (bulbs and reflectors) shall not be visible from any adjacent properties. The luminaire's front glazing shall be kept as near to parallel to the ground surface as possible (facing downwards), and shall not exceed 20 degrees from the horizontal. This scheme shall also ensure that light trespass into the windows of any light sensitive premises shall not have a Vertical Illuminance greater than 2 Lux (in accordance with the Institution of Lighting Engineers Guidance Notes for the Reduction of Obtrusive Light GN01). Reason: To protect the amenity of the adjoining properties in accordance with Policies EP2, TC1, TSM1, TSM2 and TSM3 of the South Oxfordshire Local Plan 2011.
