Conditions / Refusal Reasons
Having regard to its inappropriate form and detailing, the proposals would result in a form of development that would adversely affect the setting of frontage listed buildings, harm the historic character of the Thame Conservation Area, detract from the historic interest of the burgage plot and represent a cramped form of development, contrary to Policies CON5, CON7, CON10, H4, D1, G2 and G6 of the South Oxfordshire Local Plan 2011, and to advice set out in the South Oxfordshire Design Guide.
Having regard to the siting of the development directly adjacent to the boundary with Garden House to the west of the site, and to the excessive size, bulk and height of the building, the proposals would result in an unneighbourly form of development by reason of loss of light, overshadowing and overlooking, that would detract from the residential amenity currently enjoyed by occupants of the adjoining property. As such, the proposals would be contrary to Policies H4 and D4 of the South Oxfordshire Local Plan 2011 and to advice set out in the South Oxfordshire Design Guide.
Having regard to the siting of the development in close proximity to a mature lime tree growing directly adjacent to the east of the site, insufficient information is submitted to demonstrate that the proposals will not adversely affect the health of this tree which has significant amenity value. As such, the proposals are contrary to Policies C9, CON7 and H4 of the South Oxfordshire Local Plan 2011 and to guidance set out in the South Oxfordshire Design Guide.
