Conditions / Refusal Reasons
The development shall begin before within two years from the date of this approval for reserved matters. Reason: To comply with conditions in the outline planning permission P02/W0848/O and by virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004. That the development hereby approved shall be carried out in accordance with the details listed in the letter by RPS dated 6 October 2011 except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies. Related application(s): P12/S1174/DIS, P13/S0041/DIS

Notwithstanding the details shown on drawing 69-1681-NN2-108 Rev C the details and samples of all materials and finishes, including surface materials, to be used in the external construction and finishes of the development, shall be submitted to and approved in writing by the Local Planning Authority prior to commencment of this phase of development. For the avoidance of doubt the details approved under this condition will take precedence over details shown on the housetype elevations. Reason: To safeguard the character of the area in accordance with Policy D1 of the South Oxfordshire Local Plan 2011. Related application(s): P12/S1174/DIS, P13/S0041/DIS

That a scheme for the landscape planting of the site including live trees and shrubs, pit design and root barrier systems for tree planting within streets or hard landscaping shall be submitted to and approved in writing by the LPA prior to commencement of this phase of development. Notwithstanding the submitted details for walls, hard landscaping and/or parking, these spaces will finally be approved when the above details have been agreed. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policies C9 and D1 of the South Oxfordshire Local Plan 2011 and the South Oxfordshire Design Guide. Prior to the commencement of this phase of development details of the location and specification of street furniture, including cycle racks and stands, bus shelters, seats, signs, bollards, lighting columns,electricity supply for the northern neighbourhood square and other external structures, shall be submitted for approval in writing by the Local Planning Authority. The street furniture shall be implemented in accordance with the approved details. Reason: In the interests of design and amenity in accordance with Policies D1 and D7 of the South Oxfordshire Local Plan 2011. Related application(s): P12/S1174/DIS, P13/S0041/DIS

Prior to the commencement of this phase of development details of the tenure mix on the affordable housing units as shown on Drawing 69-1681-NN1-103 Rev D shall be submitted and approved in writing by the Local Planning Authority. The tenure for those units must be in accordance with the approved details unless otherwise agreed in writing by the Local Planning Authority. Reason: To meet the housing needs of the Council in accordance with Policy H9 of the South Oxfordshire Local Plan 2011.

Details of lighting for roads and other external areas shall be implemented in accordance with details that shall have first been submitted for approval in writing by the Local Planning Authority. In the interests of visual amenity, landscaping and highway safety and to minimise light pollution in accordance with Policies D1, C9, T1, EP3 of the South Oxfordshire Local Plan 2011.

Prior to the final occupation of this phase of development a schedule identifying plots numbers with postal addresses shall be submitted to the Local Planning Authority To enable monitoring of conditions on this development.

The retail unit to be provided within the block Plots 445-452 can be used for the following classes and for no other purpose as defined in the Schedule to the Town and Country Planning (Use Classes) Order 2010 (or any Order revoking or re-enacting that Order: 1)Class C3 residential or 2)Classes A1 or A2 retail (except as a betting office) Reason: In the interests of the amenity of local residents in accordance with Policy D5 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any Order revoking or re-enacting that Order), the enlargement, improvement or other alteration of dwellinghouses on Plots 221-231 inclusive, 288, 291 and 373, as described in Schedule 2, Part 1, Class A of the Order shall not be undertaken without the prior written permission of the Local Planning Authority. Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of amenity and in accordance with Policies G2, D1, C9, and D4 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any Order revoking or re-enacting that Order) the provision within the curtilage of Plots 221-231 inclusive, 288, 291 and 373, of any building, enclosure or swimming pool as described in Schedule 2, Part 1, Class E of the Order shall not be undertaken without the prior written permission of the Local Planning Authority. Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of amenity and in accordance with Policies G2, D1, C9 and D4 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development Order) 1995 (or any Order revoking or re-enacting that Order) the erection or construction of gates, fences, walls or other means of enclosure as described in Schedule 2, Part 2, Class A of the Order shall not be undertaken on the frontage of any dwelling without the prior written permission of the Local Planning Authority. Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of design and amenity and in accordance with Policies G2 and D1 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any Order revoking or re-enacting that Order) no development as specified in Schedule 2, Part 1, Class F of the Order shall not be undertaken within the root protection area of Plots 221-231 inclusive and Plots 235-239 inclusive without the prior written permission of the Local Planning Authority. Reason: The specific circumstances of the site warrant the Local Planning Authority having control over any further development as specified in the condition in the interests of amenity and in accordance with Policy C9 of the South Oxfordshire Local Plan 2011.

The garage accommodation on Plots 221-231 inclusive, 314-317 inclusive, 323-326 inclusive, 346, 347, 354, 355 and 356, shall not be adapted for living purposes without the prior written permission of the Local Planning Authority. Reason: In the interests of design and highway safety and to ensure the provision of adequate off-street car parking in accordance with Policies D1, T1 and T2 and Appendix 5 (Car Parking Standards) of the South Oxfordshire Local Plan 2011.

All ground floor entrances shall have a flush level access unless otherwise agreed in writing by the Local Planning Authority. Reason: To ensure that the development provides for a safe and accessible access for those with impaired mobility or access difficulties in accordance with Policy D7 of the South Oxfordshire Local Plan 2011.
