Conditions / Refusal Reasons
The development shall be carried out solely in accordance with details submitted with the application unless modified by the conditions of this permission. The details submitted consist of:

Reason: To ensure the development is carried out as proposed.
Policy: OMWLP PE18
No operations, including HGVs entering and leaving the site, other than water pumping or environmental monitoring, shall be carried out at the site except between the following times:
(a) 0700 and 1800 hours Monday to Friday and 0700 to 1600 hours Saturdays;
(b) 0800 and 1400 hours on Sundays and Public or Bank Holidays
Reason: To protect the amenities of nearby residents.
Policy: OMWLP PE18
No waste other than organic waste shall be imported to the site.
Reason: To enable the Waste Planning Authority to retain control over the development.
Policy: OMWLP W3, W5, PE18
No floodlighting shall be erected on site except in accordance with a scheme which shall be submitted to and approved in writing by the Waste Planning Authority. Floodlighting shall not operate except during the hours permitted in condition 2.
Reason: In the interests of the amenities of nearby residents.
Policy: OMWLP W3
No development shall take place except in accordance with the approved landscaping scheme as specified in Drawing no. 1147.3 Indicative Planting dated November 2011.
Reason: To reduce the visual impact on the open countryside and to screen the workings and to assist in absorbing the site back into the local landscape.
Policy: SOLP G4, C1, OMWLP W5
The existing trees, bushes and hedgerows within the site, as shown on Drawing no. 1147.3 Indicative Planting (dated November 2011) shall be retained and shall not be felled or removed.
Reason: To ensure that flora is protected from the effects of development and the development does not result in a loss of biodiversity.
Policy: SOLP G4, C1, OMWLP W5
Existing trees, shrubs and hedgerows and those planted in accordance with Drawing no. 1147.3 Indicative Planting shall be maintained to enhance biodiversity and to provide an effective visual screen between the works and properties/the highway and any plants which die at any time during the development, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of a similar size and species.
Reason: To improve the appearance of the site in the interests of visual amenity, to screen the workings, and to assist in absorbing the site back into the local landscape.
Policy: SOLP G4, C1, OMWLP W5
No vegetation shall be cleared from the land except between 1st September and 28th February (inclusive) as this is outside of the bird breeding season.
Reason: To ensure nesting birds are protected from disturbance.

Six Schweglar 1B (32mm hole) bird boxes shall be installed on suitable trees on the south-western boundary of the site during the first planting season following completion of the development hereby approved.
Reason: To ensure the development results in biodiversity enhancement.

The existing sign erected at the access informing drivers of the routes that they should use in entering and leaving the site shall be retained for the life of the permission.
Reason: In the interest of highway safety and safeguarding the local environment.
Policy: OMWLP W3, SOLP T1
The development hereby permitted shall not be brought into use until a Travel Plan has been submitted to and approved in writing by the Waste Planning Authority.
Reason: In the interest of highway safety.
Policy: OMWLP W3, SOLP T1
The development hereby permitted shall not be brought into use until the parking and turning areas have been provided in accordance with the submitted plan Drawing J9014-AD11-P500 rev A, and have been constructed, laid out, surfaced (boundary material), drained and completed, and shall be retained unobstructed except for the parking of vehicles at all times.
Reason: In the interest of highway safety.
Policy: OMWLP W3, SOLP T1
The development hereby permitted shall not be brought into use until the approved scheme (drawing no 9W9706-CADF-SK001 Rev B dated 13 October 2011 and 9W9706-CADF-TR001 Rev B dated 13 October 2011) to redesign the proposed access onto the A4074 has been implemented in full.
Reason: In the interest of highway safety and to discourage right turns to and from the A4074.
Policy: OMWLP W3, SOLP T1
No plant, machinery or vehicles shall be used on the site unless fitted with effective silencers. Any such plant or machinery shall not emit warning noise except in the form of white noise.
Reason: To safeguard the amenity of the area and local residents.

The surface of the site access shall be maintained in a good state of repair and kept clean and free from mud and other debris at all times.
Reason: In the interests of highway safety and safeguarding the local environment.
Policy: OMWLP W3
No vehicle or trailer shall enter the public highway unless their wheels and chassis have been cleaned to prevent material being deposited on the highway.
Reason: In the interests of highway safety and to prevent mud and dust getting on the highway.
Policy: SOLP T1
During dry weather a water bowser and other dust suppression measures as identified in the supporting statement dated November 2011 should be used to reduce the amount of dust on the site.
Reason: In the interests of environmental amenity.
Policy: OMWLP W3, PE18, SOLP EP1
A soil bund as shown on drawing no. 1147.3 - indicative planting shall be maintained around the perimeter of the site. The bund shall be maintained at more than 1 metre high at any point. The bund shall be seeded with rye grass mix and shall be kept free of weeds and the grass shall be cut regularly. The bund shall be constructed so that the outside of the bund should be at an angle of 30 degrees to the horizontal. The bund shall be rounded at the top and feathered into ground level so that there is no sharp angle. The top of the bund shall be graded to an even height of more than 1 metre high. The development shall not be brought into use until the bund has been constructed in accordance with this condition.
Reason: To mitigate noise and dust and in the interest of local and visual amenity.

Samples of the exterior materials proposed to be used for the reception building, wood chip building and tanks as shown on approved plan J9014-AD11-P300 rev A shall be submitted to and approved in writing by the Waste Planning Authority prior to the start of construction of the proposed buildings. No development shall take place except in accordance with these approved materials.
Reason: In the interests of visual amenity.
Policy: OWMLP W3
The development hereby permitted shall not be brought into use until full design details of the proposed housing of the gas flare has been submitted to and approved in writing by Waste Planning Authority. The housing for the gas flare shall be erected in accordance with the approved details.
Reason: To safeguard the amenity of the area and local residents.
Policy: OMWLP W3
Prior to any demolition works on the site a professional archaeological organisation acceptable to the Waste Planning Authority shall prepare an Archaeological Written Scheme of Investigation, relating to the application site area, which shall be submitted to and approved in writing by the Waste Planning Authority.
Reason: To safeguard the recording and inspection of matters of archaeological importance on the site.
Policy: PPS5
Following the approval of the Written Scheme of Investigation referred to in condition 21, no development shall commence on site without the appointed archaeologist being present. Once the archaeological monitoring and recording has been completed its findings shall be reported to the Waste Planning Authority, as agreed in the Written Scheme of Investigation, including all processing, research and analysis necessary to produce an accessible and useable archive and a full report for publication.
Reason: To safeguard the recording and inspection of matters of archaeological importance on the site.
