Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, Rev 01 revision A - Groundfloor general arrangement, Rev 02 - First floor general arrangement, Rev 03 - East and West elevations, Rev 04 - North and South elevations, Rev 05 revision C - Block and roof plan, Rev 06 - Site sections, Rev 06 - Site location plan, Midland site survey, J& L Traffic Plan rec 1 September 2011, Method Statement rec 19 September 2011 except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
That the houses, hereby permitted shall be constructed in the approved cedar boarding, Ibstock Ivanhoe Antique brick and Sandtoft Alban tiles, unless otherwise agreed in writing by the Local Planning Authority.
Reason: To ensure that the details of the development are satisfactory in accordance with Policy D1 of the South Oxfordshire Local Plan 2011.
That the landscaping scheme shall be submitted in accordance with drawing number REV05 rev C, unless otherwise agreed in writing by the Local Planning Authority. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in accordance with Policies C9 and D1 of the South Oxfordshire Local Plan 2011.
That the development shall be constructed in accordance with drawing no. 01 Rev A - Retaining Walls and Levels, unless otherwise agreed in writing by the Local Planning Authority.
Reason: To ensure that the development is not unneighbourly or intrusive in accordance with Policies G2, D1, D4 and H4 of the South Oxfordshire Local Plan 2011.
That all site clearance works and constrcution shall accord with the details set out in the J&L Traffic Plan document rec on 15 September 2011, unless otherwise agreed in writing by the Local Planning Authority.
Reason: In the interest of highway safety and to mitigate the impact of construction vehicles on the surrounding highway network, road infrastructure and local residents in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.
That all site clearnace works and development on the site shall accord with the Construction Method Statement, unless otherwise agreed in writing by the Local Planning Authority.
Reason: To ensure the details of the development are satisfactory and the works shall not have a detrimental impact on highway safety and convenience in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.
The hours of operation for construction and demolition works shall be restricted to 08:00-18:00 Monday to Friday and 08:00-13:00 on a Saturday. No work to take place on Sundays or Public Holidays without the prior written authority of the Local Planning Authority.
Reason: To protect the occupants of nearby residential properties from noise disturbance in accordance with Policy EP2 of the South Oxfordshire Local Plan 2011.
Prior to occupation of the dwelling, hereby permitted the proposed means of access onto Ladder Hill (Drawing 09052/09052-P01) is to be formed and laid out to the approval of the Local Planning Authority, constructed in accordance with the local authoritys specifications (including vision splays, which shall be
provided to each of the sides of the access down to a height of 600mm above the ground) and all ancillary works specified shall be undertaken.
For the avoidance of doubt: The design shall demonstrate that sufficient pedestrian indivisibility can be achieved at the access, in accordance with the approved standards of South Oxfordshire District Council.
Reason: In the interest of highway safety and in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.
Prior to the first occupation of the development, the parking and turning areas shall be provided in accordance with the approved plan and shall be constructed, laid out, surfaced (bound material), drained and completed, and shall be retained unobstructed except for the parking of vehicles at all times.
Reason: In the interests of highway safety and in accordance with Policies T1 and T2 and Appendix 5 (Car Parking Standards) of the South Oxfordshire Local Plan 2011.
Prior to the first occupation of the development, the parking and turning areas shall be provided in accordance with the approved plan drawing no. Rev 01 - Ground Floor General Arrangement and shall be constructed, laid out, surfaced (bound material), drained and completed, and shall be retained unobstructed except for the parking of vehicles at all times.
Reason: In the interests of highway safety and in accordance with Policies T1 and T2 and Appendix 5 (Car Parking Standards) of the South Oxfordshire Local Plan 2011.
Notwithstanding the submitted Drawing Rev 01 Ground Floor General Arrangement any gates provided shall be set back a minimum of 5.0 metres from the back of footway, and shall open inwards into the site. Additionally the doors fitted onto the proposed refuse area shall not open over the manoeuvring area required to access and egress the site.
Reason: To ensure that vehicles may wait clear of the carriageway or footway while the gates are opened or closed in the interests of highway safety and in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any Order revoking or re-enacting that Order), the enlargement, improvement or other alteration of any dwellinghouse as described in Schedule 2, Part 1, Class A of the Order shall not be undertaken without the prior written permission of the Local Planning Authority.
Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of amenity and in accordance with Policies G2 and D1 of the South Oxfordshire Local Plan 2011.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any Order revoking or re-enacting that Order) the provision within the curtilage of the dwelling of any building, enclosure or swimming pool as described in Schedule 2, Part 1, Class E of the Order shall not be undertaken without the prior written permission of the Local Planning Authority.
Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of amenity and in accordance with Policies G2, D1 and D4 of the South Oxfordshire Local Plan 2011.
Prior to the commencement of any site works (including demolition or site clearance) a protected area shall be designated for all existing trees which are shown to be retained, and the trees shall be protected in accordance with the current edition of BS 5837: "Trees in Relation to Construction". These measures shall be kept in place during the entire course of development
Reason: To safeguard trees which are visually important in accordance with Policies C9 and D1 of the South Oxfordshire Local Plan 2011.
