Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 1149/20, 1149/21, 1149/23b and 1149/24a, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
That the materials to be used for the external walls and roof of the extension shall be of the same colour, type and texture as those used on the existing two storey extension.
Reason: To ensure that the details of the development are satisfactory in accordance with Policies C2, D1, G6 and H13 of the South Oxfordshire Local Plan 2011.
The exterior of the garage hereby permitted shall only be constructed in the materials specified on the plans hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority.
Reason: In the interests of the appearance of the development and in accordance with Policies C2, D1, G6 and H13 of the South Oxfordshire Local Plan 2011.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order), no window(s), door(s) or other openings other than those shown on the approved plans shall be inserted in the walls or roof of the garage hereby permitted.
Reason: To safeguard the amenities of adjoining occupiers and the character of the area in accordance with Policies D1, G6, H13 and C2 of the South Oxfordshire Local Plan 2011.
The outbuilding hereby permitted shall not be occupied at any time other than for purposes incidental to the residential use of the dwelling known as Kates Cottage.
Reason: The creation of a separate dwelling in this location would result in an undesirable division of the plot and inadequate levels of privacy for the occupiers of Kates Cottage and the new dwelling and would lead to highway implications contrary to Policies D4 and T2 of the South Oxfordshire Local Plan 2011.
That any trees that are damaged or removed as a result of the development shall be replaced in accordance with a landscaping scheme to be submitted to and approved in writing by the Local Planning Authority. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged within 5 years of the completion of the development, a new tree of a species first approved by the Local Planning Authority shall be planted and properly maintained in a position first approved by the Local Authority.
Reason: To ensure that there is no net loss in the districts biodiversity resources in accordance with Policy C6 of the South Oxfordshire Local Plan 2011.
