Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 11_2151_LOC A, 11_2151_PL10, 11_2151_PL11, 11_2151_PL12, 11_2151_PL13, 11_2151_PL14, 11_2151_PL15, 11_2151_PL16, 11_2151_PL17, 11_2151_PL18, 11_2151_PL19, 11_2151_PL20, 11_2151_PL21, 11_2151_PL22, 11_2151_PL24, 11_2151_PL23A, 3834/501A, 3834/002 and 3834/003, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

The exterior of the development hereby permitted shall only be constructed in the materials specified on the schedule accompanying the application hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority. Reason: In the interests of the appearance of the development and in accordance with Policies G2, G6, C2, D1 and E3 of the South Oxfordshire Local Plan 2011.

The measures set out in the design statement, energy statement and sustainability statement, which accompanied the application, in respect of sustainable building, shall be implemented in accordance with the statement prior to the first occupation of the development, unless as may otherwise be agreed in writing by the Local Planning Authority and thereafter retained as approved. Reason: To ensure sustainable development in accordance with Policies G2, D8 and E3 of the South Oxfordshire Local Plan 2011.

Prior to first occupation of the extension hereby permitted the proposed construction access onto Blounts Court Road is to be returned to its previous condition and thereafter retained as such. Reason: In the interest of highway safety and in accordance with Policies G2, E3 and T1 of the South Oxfordshire Local Plan 2011.

The vision splays hereby approved on plan 3834/002 and 3834/003 for the construction access shall not be obstructed by any object, structure, planting or other material with a height exceeding or growing above 0.9 metres as measured from carriageway level during the use of the access by construction vehicles. Reason: In the interest of highway safety and in accordance with Policies G2, E3 and T1 of the South Oxfordshire Local Plan 2011.

Prior to the first occupation of the development, the parking and turning areas shall be provided in accordance with the approved plan 3834/501A and shall be constructed, laid out, surfaced (bound material), drained and completed, and shall be retained unobstructed except for the parking of vehicles at all times. Reason: In the interests of highway safety and in accordance with Policies G2, D2, E3, T1 and T2 and Appendix 5 (Car Parking Standards) of the South Oxfordshire Local Plan 2011.

The development hereby approved shall be carried out in all respects in accordance with the approved Construction Traffic Management Plan October 2011 Issue 2 received 21st December 2011. This shall include no construction deliveries to the site during peak hours and no construction traffic shall travel to and from the site from the B481 using Widmore Lane except for construction traffic entering the car park whilst the car parking works are undertaken. Any variation to the approved details shall be submitted to and agreed in writing by the local planning authority prior to the commencement of works. Reason: In the interests of highway safety and in accordance with Policies G2, E3, T1 and T2 and Appendix 5 (Car Parking Standards) of the South Oxfordshire Local Plan 2011.

Wheel washing facilities shall be established for the construction access in accordance with the approved Construction Traffic Management Plan October 2011 Issue 2 received 21st December 2011 and agreed details set out in the Mr Mackley's email dated 6th February 2012, namely a temporary standpipe near to the construction access, supplied by an existing water service pipe on the Johnson Matthey site which runs close to the field boundary. Such facilities shall be established prior to the commencement of demolition or construction and shall be kept in operation at all times during demolition and construction works. Any variation to the approved details shall be submitted to and agreed in writing by the local planning authority prior to the commencement of works. Reason: To prevent the tracking out of materials onto the highway in the interests of highway safety and in accordance with Policies G2, E3 and T1 of the South Oxfordshire Local Plan 2011.

The Interim Travel Plan hereby approved shall be updated and submitted to the local planning authority within 3 months of occupation of the development. Following local planning authority approval, the agreed measures shall be implemented and retained as approved. Reason: To promote the use of non car modes of transport in accordance with national guidance in PPG13: Transport and Policies G2, E3 and T3 of the South Oxfordshire Local Plan 2011.

Measures to prevent discharge of surface water drainage from the main car park to the highway shall be implemented during the course of the alterations in accordance with approved plans 3834/503A, 3834/504A and 3834/506A and thereafter retained as such. Reason: In the interests of highway safety and in accordance with Policies G2, EP6, E3 and T1 of the South Oxfordshire Local Plan 2011.

The landscaping of the site shall be implemented in accordance with the approved scheme detailed in the report d329/00 and shown on plan d329/001 within the first planting season of the occupation of the development hereby permitted and thereafter maintained as approved. Reason: In order to provide replacement tree planting to maintain the arboricultural value of the site within its Chilterns AONB landscape setting in accordance with Policies G2, C2, C4, C9 and E3 of the South Oxfordshire Local Plan 2011.

Prior to the commencement of any on site works, the tree protection measures shall be implemented in accordance with the revised Arboricultural Method Statement received 6th February 2012. The agreed measures shall be retained as approved for the duration of development. Reason: In order to maintain the arboricultural value of the site within its Chilterns AONB landscape setting in accordance with Policies G2, C2, C4, C9 and E3 of the the South Oxfordshire Local Plan 2011.

The extension hereby permitted shall not be occupied at any time other than for purposes ancillary to the use of the site by Johnson Matthey PLC Technology Centre. Reason: As the separate occupation of the accommodation would represent an undesirable sub-division of the site and result in potential intensification of the use of the site and highway safety concerns in accordance with Policies G2, E3 and T1 of the South Oxfordshire Local Plan 2011.

The air source heat pump and any associated equipment to be used by reason of the granting of this permission shall be so installed, maintained and operated so as to ensure that the rating noise level from the equipment does not exceed the background noise level at the boundary of the premises. The measurement and rating of noise for the purposes of this condition shall be in accordance with BS: 4142 (1997) Method for rating industrial noise affecting mixed residential and industrial areas. Reason: To protect the occupants of nearby residential properties from noise disturbance in accordance with Policies G2, EP2 and E3 of the South Oxfordshire Local Plan 2011.
