Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, TDS/153/BS/1050, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The facing bricks to be used in the construction of the conservatory hereby permitted shall match those used on the existing building.
Reason: To safeguard the character of the area in accordance with Policies G2, G6, D1 and H5 of the South Oxfordshire Local Plan 2011.
The first floor landing window and ground floor WC window in the north-west elevation of the dwelling hereby permitted shall be glazed in obscure glass and fixed shut below a height of 1.7 metres above internal floor level, prior to the first occupation of the accommodation and it shall be retained as such thereafter.
Reason: To ensure that the development is not unneighbourly in accordance with Policies G2, D4 and H5 of the South Oxfordshire Local Plan 2011.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any Order revoking or re-enacting that Order), the enlargement, improvement or other alteration, the extension of the roof, the erection of a porch, outbuildings or hardstandings to the dwellinghouse hereby approved as described in Schedule 2, Part 1, Classes A, B, D, E and F of the Order shall not be undertaken without the prior written permission of the Local Planning Authority.
Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of amenity and in accordance with Policies G2, G6, D1, D4 and H5 of the South Oxfordshire Local Plan 2011.
The measures listed in the covering letter dated 5th May 2011 in support of application P11/E0767/DIS shall be implemented prior to first occupation of the dwelling hereby approved and thereafter retained as approved, unless as may otherwise be agreed in writing by the Local Planning Authority.
Reason: To ensure high standards in the efficient use of energy, water and materials in accordance with Policies G2, D8 and H5 of the South Oxfordshire Local Plan 2011.
Prior to the first occupation of the development, the parking areas shall be provided in accordance with the approved plan TDS/153/BS/1050 and shall be constructed, laid out, surfaced (bound material), drained and completed, and shall be retained unobstructed except for the parking of vehicles at all times.
Reason: In the interests of highway safety and in accordance with Policies G2, G6, D2, H5, T1 and T2 and Appendix 5 (Car Parking Standards) of the South Oxfordshire Local Plan 2011.
Cycle parking facilities shall be provided prior to first occupation of the development in accordance with the details shown on the approved plan TDS/153/BS/1050 and thereafter shall be retained as such.
Reason: To encourage the use of cycles as a means of transport in accordance with Policies G2, D2, H5 and T2 and Appendix 5 (Parking Standards) of the South Oxfordshire Local Plan 2011.
The external areas shall be landscaped as shown on the approved plan TDS/153/BS/1050 including the retention of the hedge along the boundary with No.26. The scheme shall also include the planting of shrub planting Berberis Thunbergii in the planter on the front elevation as previously approved under application P11/E0767/DIS.
Reason: To help to assimilate the development into its surroundings in accordance with Policies G2, G6, C9, D1 and H5 of the South Oxfordshire Local Plan 2011.
The development hereby permitted shall not be occupied until surface water drainage works have been carried out in accordance with details that have been submitted to and approved in writing by the Local Planning Authority.
Reason: To prevent pollution and flooding in accordance with Policies G2, EP1, EP4, EP6 and H5 of the South Oxfordshire Local Plan 2011.
