Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, DAS01, 24 and 25, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

Notwithstanding the details shown on plan 08-614/24, a plan showing a bell-mouth wide enough to enable simultaneous vehicular access and egress shall be submitted to and approved in writing by the Local Planning Authority prior to first occupation of the replacement dwelling on the site and thereafter the approved means of access onto Red Lane is to be formed and laid out in accordance with the approved details to local authority's specifications and all ancillary works specified shall be undertaken prior to first occupation of the replacement dwelling and thereafter retained as approved. Reason: In the interest of highway safety and in accordance with Policies G2, H13 and T1 of the South Oxfordshire Local Plan 2011.

Before the proposed access is first used, the existing access onto the farm track to the north of the site shall be permanently stopped up by the means of reinstatement of the boundary and details of proposed planting to be submitted to and approved in writing by the Local Planning Authority prior to first occupation of the replacement dwelling. Thereafter the closed access shall not be used by any vehicular traffic whatsoever. Reason: In the interest of highway safety and in accordance with Policies G2, H13 and T1 of the South Oxfordshire Local Plan 2011.

No surface water from the development shall be discharged onto the adjoining highway and a scheme to prevent this occurrence shall be submitted to and approved in writing by the Local Planning Authority and constructed prior to the occupation of the replacement dwelling on the site. Reason: In the interests of highway safety and in accordance with Policies G2, EP6, H13 and T1 of the South Oxfordshire Local Plan 2011.

Any gates provided shall be set back a minimum of 5.0 metres from the edge of the carriageway and shall open inwards into the site. Reason: To ensure that vehicles may wait clear of the highway while the gates are opened or closed in the interests of highway safety and in accordance with Policies G2, H13 and T1 of the South Oxfordshire Local Plan 2011.
