Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 01A; 04A; 05B; 06B; 07A; 08B; and 09A, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

Samples of the materials to be used for the external walls and roofs of the development hereby approved shall be submitted to and approved in writing by the Local Planning Authority before any development commences. Reason: In the interests of the visual appearance of the site in accordance with Policies G2, G6, CON5, CON7, D1 and H4 of the South Oxfordshire Local Plan 2011.

Notwithstanding any details shown on the approved plans, a scheme for the means of treatment of the hard surfaced areas of the site and for fencing and other means of enclosure shall be submitted to and approved in writing by the Local Planning Authority before any development starts on site. The development shall not be occupied before the hard surfaced areas, fencing and other means of enclosure have been constructed in accordance with the approved details. Reason: In the interests of the visual appearance of the site in accordance with Policies G2, G6, CON5, CON7, D1, and H4 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 or any subsequent revision, no alterations or extensions to Flat 7 as indicated on the approved plans shall be built, unless permission has been granted by the Local Planning Authority on an application made for the purpose. Reason: In the interests of the visual appearance of the site in accordance with Policies G2, G6, CON5, CON7, D1 and H4 of the South Oxfordshire Local Plan 2011.

The development hereby permitted shall be designed to incorporate sustainable methods of construction in accordance with details which shall first have been submitted to and approved in writing by the Local Planning Authority prior to commencement of the development. The approved sustainability measures shall thereafter be retained. Reason: To ensure high standards in the conservation and efficient use of energy, water and materials, in accordance with Policy D8 of the South Oxfordshire Local Plan 2011.

Notwithstanding the details shown on the approved plans, cycle parking facilities shall be provided prior to the first occupation of the development hereby approved, in accordance with details to be submitted to and approved in writing by the Local Planning Authority, prior to the commencement of development. Reason: To encourage the use of cycles as a means of transport in accordance with Policy T2 and Appendix 5 (Parking Standards) of the South Oxfordshire Local Plan 2011.

Prior to the first occupation of any of the flats hereby approved, the parking and turning areas shall be provided in accordance with the approved plan, 04A, and shall be constructed, laid out, surfaced, drained and completed, and shall be retained unobstructed except for the parking of vehicles at all times. Reason: In the interests of highway safety and in accordance with Policies T1 and T2 and Appendix 5 (Car Parking Standards) of the South Oxfordshire Local Plan 2011.

That a scheme for the landscaping of the site, including the planting of live trees and shrubs, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: In the interests of the visual appearance of the site in accordance with Policies G2, G6, CON5, CON7, D1 and H4 of the South Oxfordshire Local Plan 2011.

The tree protection measures as detailed within the Tree Survey Report by B. J. Unwin Forestry Consultancy dated September 2011 shall be in place prior to the commencement of any work and during the entire course of the development. Reason: To safeguard trees which are visually important in accordance with Policies G2, G6, C1, C2, C9, CON7, D1 and H4 of the South Oxfordshire Local Plan 2011.

The development hereby approved shall not be occupied until surface water drainage works have been carried out in accordance with details submitted to and approved in writing by the Local Planning Authority. Reason: To prevent pollution and flooding in accordance with Policies EP1 and EP6 of the South Oxfordshire Local Plan 2011.

The development permitted by this planning permission shall only be carried out in accordance with the approved Flood Risk Assessment (FRA), ENV/0208/11FRA undertaken by AAH Planning Consultants dated September 2011 and the following mitigation measures detailed within the FRA: Finished floor levels are set no lower than 36.38m above Ordnance Datum (AOD). Reason: To reduce the risk of flooding to the proposed development and future occupiers in accordance with PPS 25.
