Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 06.173.1001, 06.173.1002, 06.173.1003, 06.173.1004 and 06.173.1005, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

The exterior of the development hereby permitted shall only be constructed in the materials specified on the plans hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority. Reason: In the interests of the appearance of the development and in accordance with Policies G2, G6, CON7 and D1 of the South Oxfordshire Local Plan 2011.

The orangery hereby approved shall be constructed and maintained in accordance with the specifications detailed in the acoustic report prepared by Alpha Acoustics, (Ref:AA371/06/04/2011-final, dated 1 July 2011)and as further clarified by letter dated 9 September 2011 from Alpha Acoustics in respect of non-openable windows and ventilation plant. Reason: To protect the occupants of nearby residential properties from noise disturbance in accordance with Policy EP2 of the South Oxfordshire Local Plan 2011.

The use of the orangery by patrons shall be restricted to between the hours of 07:00 and midnight. Reason: To protect the occupants of nearby residential properties from noise disturbance in accordance with Policy EP2 of the South Oxfordshire Local Plan 2011.

All windows and doors in the orangery hereby approved, other than those providing access from the main dining area to the orangery, shall be non-opening and fixed shut (except in the case of an emergency). Reason: To protect the occupants of nearby residential properties from noise disturbance in accordance with Policy EP2 of the South Oxfordshire Local Plan 2011.

Lighting within the orangery shall be extinguished outside the hours of 7.00 am to midnight except where required for emergency use. Reason: To protect local residents from light pollution in accordance with Policy EP3 of the South Oxfordshire Local Plan 2011.

No live or recorded music shall be played within the orangery Reason: To protect the occupants of nearby residential properties from noise disturbance in accordance with Policy EP2 of the South Oxfordshire Local Plan 2011.

Details of any additional mechanical ventilation required to cool the orangery hereby approved shall be submitted to and approved in writing by the Local Planning Authority prior to any work commencing on site. Reason: To protect the occupants of nearby residential properties from noise disturbance in accordance with Policy EP2 of the South Oxfordshire Local Plan 2011.

That, notwithstanding the details shown on the approved plans, the windows in the southwestern side elevation of the orangery hereby permitted shall be glazed in obscure glass prior to the first occupation of the accommodation and they shall be retained as such thereafter. Reason: To ensure that the development is not unneighbourly in accordance with Policy D4 of the South Oxfordshire Local Plan 2011.
