Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 084/PL/P/00, 084/PL/P/01, 084/PL/P/02.1, 084/PL/P/02, 084/PL/P/03, 084/PL/P/04, 084/PL/P/05, 085/PL/P/06, 084/PL/P07, 084/PL/P08, 084/PL/P-09, 084/PL/P/10, 084/PL/P/11, P84/PL/P/12, 084/PL/P/13, 084/PL/P/14, 084/PL/P/15, 084/PL/P/15.1, 084/PL/P/16, 084/PL/P/17 and 084/PL/P18 except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

That samples of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority before the development is commenced. Reason: To ensure that the details of the development are satisfactory in accordance with Policies G2, G6, C2 and H13 of the South Oxfordshire Local Plan 2011.

Prior to the commencement of any site works (including demolition or site clearance) the tree protection measures detailed in the Tree Survey dated February 2007 which accompanied the application shall be provided on site. The tree protection measures shall be kept in place during the entire course of development Reason: To safeguard trees which are visually important in accordance with Policies C9 and D1 of the South Oxfordshire Local Plan 2011.

That a scheme for the landscaping of the site, including the planting of live trees and shrubs, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policies C9 and D1 of the South Oxfordshire Local Plan 2011.

That prior to the first use of the new stable building, the existing stable building shall be demolished and the materials shall be permanently removed from the site. Reason: To safeguard the character of the area and the Chilterns Area of Outstanding Natural Beauty in accordance with Policies G2, G6, D1, C2 and H13 of the South Oxfordshire Local Plan 2011.

That prior to the first use of the new garage building, the existing garage shall be demolished and the materials shall be permanently removed from the site. Reason: To safeguard the character of the area and the Chilterns Area of Outstanding Natural Beauty in accordance with Policies G2, G6, D1, C2 and H13 of the South Oxfordshire Local Plan 2011.

That prior to the commencement of the development hereby approved, slab levels relating to the new stable block and garage shall be submitted to and approved in writing by the Local Planning Authority. Reason: To ensure that the details of the development are satisfactory in accordance with Policies G2, G6, C2 and R10 of the South Oxfordshire Local Plan 2011.

The garage hereby permitted shall not be used at any time other than for the parking of vehicles and purposes incidental to the residential use of the dwelling known as Langtree House. Reason: As the separate occupation of the garage building would be contrary to the Council's housing policies and would represent an undesirable sub-division of the property and result in inadequate standards of amenity and privacy and in accordance with the provisions of Policies G2, G6, C2, D1, H6 and H13 of the South Oxfordshire Local Plan.

That the new stable facilities hereby approved shall be used only for the personal enjoyment of the occupiers of Langtree House and shall not be used for any commercial purpose. Reason: To secure the proper planning of the locality in accordance with Policies G2, C2 and R10 of the South Oxfordshire Local Plan.

No part of the development to which this permission relates shall be implemented in addition to the garage with underground plant, store and cellar permitted under reference P07/E0281. Accordingly, this permission shall be an alternative garage scheme so that either garage, but not both, may be implemented. Reason: To prevent the implementation of two garage schemes and to safeguard the character and appearance of the site and the surrounding Area of Outstanding Natural Beauty in accordance with Policies G2, G6, C2, D1 and H13 of the South Oxfordshire Local Plan 2011.
