Barn conversion to form residential dwelling (As amended by Drawing Numbers 1386-02C & 06 accompanying letter from Agent dated 1 April 2011, as amplified by additional information received from the Agent dated 26th April 2011 & as amplified by Bat Survey accompanying e-mail from Agent dated 18 May 2011).
Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 1386.01a, 1386.03a, 1386.04a, 1386.02C and 1386.06, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
Prior to the commencement of development samples of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority.
Reason: To safeguard the character of the building and the area in accordance with Policies G6, CON2, CON3, CON7 and D1 of the South Oxfordshire Local Plan 2011.
That development shall not begin until a detailed specification at scales 1:5 and 1:20 of the type, design and external finish of all windows, external doors and rainwater goods has been submitted to and approved in writing by the Local Planning authority. The development shall be carried out in accordance with the approved plans.
Reason: To ensure that the details of the development are satisfactory in accordance with Policies G6, CON2, CON3, CON7 and D1 of the South Oxfordshire Local Plan 2011.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (Amendment) (No.2) Order 2008 (or any order revoking and re-enacting that Order), no extensions, roof extensions or additional windows, doors or rooflghts shall be added to the building without the prior grant of planning permission from the Local Planning Authority.
Reason: To ensure that the details of the development are satisfactory in accordance with Policies G6, CON2, CON3, CON7 and D1 of the South Oxfordshire Local Plan 2011.
That the sustainable design features, as specified in the Design and Access Statement accompanying the application shall be incorporated into the dwelling hereby approved, and shall thereafter be retained.
Reason: To ensure high standards in the efficient use of energy, water and materials in accordance with Policy D8 of the South Oxfordshire Local Plan 2011.
Prior to the first occupation of the barn conversion, the parking and turning areas shall be provided in accordance with the submitted plan Drawing 1386/02c, and shall be constructed, laid out, surfaced, drained and completed, and shall be retained unobstructed except for the parking of vehicles at all times.
Reason: In the interest of highway safety and in accordance with Policy T1 and T2 and
Appendix 5 (Car Parking Standards) of the South Oxfordshire Local Plan 2011.
That the tree protection measures shall be implemented in accordance with the Arboricultural Report dated February 2011 accompanying the application and shall be kept in place for the entire course of the development. The tree protection measures set out in the report shall be altered to include tree protection measures between trees T6 and T9 to provide suitable tree protection methods for the insertion of the window in the gable end of the building, in accordance with details which shall first have been submitted to and approved in writing by the Local Planning Authority.
Reason: To safeguard trees which are visually important in accordance with Policies C9, CON7 and D1 of the South Oxfordshire Local Plan 2011.
That prior to the first occupation the barn conversion, a collection area of minimum size 600mm x 1500mm shall be provided within the property boundary, as close as possible to the Upper High Street, for the collection of waste and recycling bins.
Reason: To ensure efficient collection of waste in accordance with Policy D10 of the South Oxfordshire Local Plan 2011.
The development hereby permitted shall be implemented in accordance with the recommendations of the Ecology and Protected Species Appraisal (17 May 2011) submitted with the application in all respects. Any variation shall be agreed in writing by the Local Planning Authority before such change is made.
This condition will be discharged on receipt of a letter from the project ecologist stating that the mitigation has been completed according to the approved report.
Reason: To protect the important species on the site, in accordance with Policy C8 of the South Oxfordshire Local Plan 2011.
That a scheme for the landscaping of the site, including the planting of live trees, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or equivalent number of trees, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in accordance with Policies C9, CON7 and D1 of the South Oxfordshire Local Plan 2011.
