Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004. Related application(s): P10/W1445/DIS

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 580-1 and 580-2, 65MS002 Sheet 1 and 2, 610/003 Rev B, Site Location Plan, Landscape and Visual Impact Assessment, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

That within 18 months of the date of this permission, or 2 months of the first use of the new access hereby permitted, the temporary access shall be removed and the land returned to agriculture. Reason: That the construction of a permanent access in the location shown would detract from the visual amenity of the locality, contrary to policies G2 and C1 of the South Oxfordshire Local Plan.

That prior to the construction of the new access, a scheme for the establishment of a new road side hedge, behind the vision splay, shall be submitted to and approved in writing by the local planning authority. The scheme shall be implemented as approved in the first planting season following the commencement of the works. In the event of any of the plants dying or becoming seriously damaged or destroyed within 5 years of planting, replacement shrubs or plants shall be planted and the replacements properly maintained. Reason: To help to assimilate the development into its surroundings in accordance with Policies C9 and D1 of the adopted South Oxfordshire Local Plan.

That the existing hedge shall not be removed between 1 March and 31 July. Reason: To protect nesting birds in accordance with Policy C6 of the adopted South Oxfordshire Local Plan.

The proposed modified means of accesses and visibility splays onto the A417 are to be formed, laid out and constructed in accordance with the submitted Drawings 580/1 and 580/2. Reason: in the interest of highway safety and in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.
