The development shall be carried out strictly in accordance with the particulars of the development, plans and specifications contained in the application except as modified by conditions of this permission. The approved plans and particulars comprise: - Application form dated 24th September 2009 - Supporting Statement dated December 2009 - Noise Impact Assessment dated 8th December 2009 prepared by 24 Acoustics Ltd. - Air Quality Assessment dated December 2009 prepared by Alex Grant AirQ - Drawing EWELME/TWTS/01 (Location Plan) dated December 2008 - Drawing EWELME/TWTS/01 Rev A (Application Area) dated September 2009 - Drawing 2001 Rev C (Option 2 ¿ Phase 1 General Arrangement Drainage and Levels) dated August 2008 - Drawing 2503 Rev A (Option 2 ¿ Phase 1 Construction Details) dated August 2008 - Drawing 2504 (Option 2 ¿ Phase 1 Construction Details) dated March 2009 - Drawing FS-EWE-840 (Proposed Building Layout to be used Initially for the New Temporary Hazardous Waste Housing then later to be used as New Fabrication workshop) dated 16th January 2009. Reason: To ensure the development is carried out as proposed.

The development to which this permission relates shall be begun not later than the expiration of three years beginning with the date of this permission. Reason: To comply with Section 91 to 95 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.

The processing of waste shall cease three years from the date of this permission and the plant and buildings to which this permission relates shall be demolished and removed within three months of the cessation of development and the site shall be left in a neat and tidy condition appropriate for inclusion in the general depot area. Reason: To ensure the prompt and effective restoration. ( MWLP PE18)

No operations authorised by this permission, including vehicles entering or leaving the site, shall take place except between the following times: 07:00 to 18:00 Mondays to Fridays 07:00 to 13:00 Saturdays. No operations shall take place on Sundays, Bank or Public Holidays. Reason: To protect the amenities of local residents and visitors to the area (MWLP PE18).

No mud or dust shall be deposited on the public highway. Reason: In the interests of highway safety (MWLP PE18).

Details of the location, height, design, sensors and luminance of external lighting (which shall be designed to minimise the potential nuisance of light spillage on adjoining properties and highways) shall be submitted to and approved in writing by the Mineral Planning Authority before any external lighting is used on site. Any scheme that is approved shall be implemented for the life of the site. Reason: To minimise the nuisance and disturbances to neighbours and the surrounding area and in the interests of highway safety (MWLP PE18).

All vehicles, plant and machinery operated within the site shall be fitted with and use effective silencers. Reason: To ensure minimum disturbance from operations and avoidance of nuisance to the local community (MWLP PE18).

Within 6 months of the date of this permission a scheme to deal with the risks associated with contamination of the site shall each be submitted to and approved by the Waste Planning Authority. The scheme shall include: I. A preliminary risk assessment which has identified: ¿ all previous uses ¿ potential contaminants associated with those uses ¿ a conceptual model of the site indicating sources, pathways and receptors ¿ potentially unacceptable risks arising from contamination at the site. II. A site investigation scheme, based on (I) to provide information for a detailed assessment of the risk to all receptors that may be affected, including those off site. III. The site investigation results and the detailed risk assessment (II) and, based on these, an options appraisal and remediation strategy giving full details of the remediation measures required and how they are to be undertaken. IV. A verification plan providing details of the data that will be collected in order to demonstrate that the works set out in (III) are complete and identifying any requirements for longer-term monitoring of pollutant linkages, maintenance and arrangements for contingency action. Reason: To protect groundwater quality (MWLP W7).

On completion of any remediation measures required by condition 8 a verification report confirming that the remediation measures have been undertaken in accordance with the method statement shall be submitted to the Minerals and Waste Planning Authority. The verification report shall set out measures for maintenance, further monitoring and reporting. Reason: To protect groundwater quality (MWLP W7)

Within 6 months of the date of this permission a scheme to dispose of foul and surface water has been submitted to, and approved in writing by, the local planning authority. The scheme shall include: ¿ Details confirming that surface water drainage from high risk areas are isolated and will not enter infiltration systems. ¿ Infiltration drainage must not be located in contaminated areas. ¿ Confirmation of the depth of any infiltration system in relation to groundwater levels at this site. Any scheme that is approved shall be implemented. Reason: To protect groundwater quality (MWLP W7).

Within 6 months of permission being issued, the applicant shall submit to the planning authority a planting scheme for the hedgerow which runs adjacent to the northern bund showing on approved drawing 2001 Rev C Option 2 ¿ Phase 1 General Arrangement Drainage and Levels) dated August 2008. The scheme shall include: ¿ Species mix (species should be of local provenance and appropriate to the local area) ¿ Plant size ¿ Planting layout ¿ Planting spacing ¿ Methods of establishment Reason: To improve the appearance of the site in the interests of visual amenity, to screen the workings, and the assist in absorbing the site back into the local landscape in accordance with Section 197 of the Town and Country Planning Act and to ensure that the site is managed appropriately in accordance with MWLP policy PE13 and that the development results in biodiversity enhancement in accordance with the NERC Act (2006) and PPS9.

No vegetation removal shall take place until a suitably qualified ecologist has carried out a destructive search to ensure there are no protected species present (reptiles or nesting birds). A method statement for the clearance should be submitted to the Planning Authority for approval prior to any works taking place. If nesting birds are present, the vegetation must be cordoned off and protected and cannot be removed until the birds have fledged. Reason: To ensure that the site is managed appropriately in accordance with MWLP Policy PE13 and to ensure the development results in no loss of biodiversity and biodiversity enhancement in accordance with the NERC Act (2006) and PPS9.

All works shall cease immediately if protected species are found. Before any further work takes place an ecologist should be contacted immediately. Work should not recommence until a full survey has been carried out, a mitigation strategy prepared and licence obtained (if necessary) in discussion and agreement with Natural England. Reason: To ensure that the development is in accordance with the Wildlife & Countryside Act 1981 (as amended) and the development does not result in a loss of biodiversity in accordance with the NERC Act (2006) and PPS9.

Between the hours of operation stated in condition 4 the noise levels arising from the development shall not exceed 55 dB(LAeq) (1 hour), freefield at The Cottage and Goulds Grove Farm shown on Figure 1 (Site & Noise Survey Location) of the approved document ¿Noise Impact Assessment¿ dated 8th December 2009 prepared by 24 Acoustics Ltd. Reason: To protect the amenities of local residents (MWLP PE18).

No development shall take place except in accordance with the dust suppression measures specified in Section 9 of the approved document ¿Air Quality Assessment¿ dated December 2009 prepared by Alex Grant AirQ. Reason: To protect the amenities of local residents from the effects of any dust arising from the development (MWLP PE18).

All details relating to drainage and disposal of surface water as shown on drawing 007/P/27C of planning permission P98/W0683/CM shall be implemented and maintained for the life of this permission. Reason: To minimise the risk of pollution of watercourses and aquifers (MWLP PE18).

Any trees and shrubs planted in accordance with the approved scheme as shown in approved plan 007/P/27A, which die in the first five years of being planted, shall be replaced. Should plants die, details of: ¿ the replacement species; ¿ time of year of planting; and ¿ the number of plants to be re-planted shall be submitted to and approved by the local planning authority, before the work is carried out. Reason: To ensure that the site is managed appropriately in accordance with MWLP policy PE13 and to ensure the development results in no loss of biodiversity and biodiversity enhancement in accordance with the NERC Act (2006) and PPS9.

Within 3 months of the date of this permission details of signage for lorries directing them towards the A4074 shall be submitted to the local planning authority. Any details that are approved shall be implemented within 3 months of the date of approval. Reason: In the interests of highway safety (MWLP PE18).
