Conditions / Refusal Reasons
That the development be carried out strictly in accordance with the particulars of the development contained in application R3.0235/09 as shown on plan numbers B02 and B03 accompanying the application except as controlled or modified by conditions of this permission, unless otherwise agreed in writing by the Head of Sustainable Development. Reason: To ensure the details of the development are carried out in accordance with the application as approved.

That development must be begun not later than the expiration of three years beginning with the date hereof. Reason: By virtue of the provisions of Section 91 (1) 9a) of the Town and Country Planning Act, 1990.

The existing bricks shall be reused in the reconstruction of the wall hereby approved and where necessary any new bricks shall match the existing. Reason: To ensure the materials are compatible with the surrounding development and to safeguard the special architectural or historic interest of the listed wall (Policies: BE6, CC6 (RSS2026); CON3, D1 (SODCLP2011))

Sample panels of brickwork showing the proposed colour, texture, facebond and pointing shall be provided on site and approved in writing by the Head of Sustainable Development prior to the commencement of the development. The sample panels shall be retained on site until the work is completed and the new work shall be carried out in accordance with the approved panel. Reason: To ensure the materials are compatible with the surrounding development, and to safeguard the special architectural or historic interest of the listed building (Policies: CC6 (RSS2026); CON3, CON7, D1 (SODCLP2011)).

That no development shall take place until the trees on the site which are to be retained and which are adjacent to or within the development area, have been protected during building operations by means of a protective fence around the edge of the canopy of the trees in accordance with B.S. 5837: 2005, and with the written requirements (copy attached) of the Head of Sustainable Development relating to the protection of trees. Furthermore, no works or storing of plant or materials shall be carried out within the fenced area. Reason: To ensure the protection of trees on the land and to preserve the amenities of the locality. (Policies: C4 (RSS2026); CA SODCLP2011))

No development shall take place until a professionally competent archaeological organisation, as approved in writing by the Head of Sustainable Development, has been commissioned to carry out a full watching brief during the period of construction works. The watching brief shall preserve by record any archaeological features which may arise in the course of the works and shall include limited archaeological excavation where necessary and the retrieval of artefactual evidence. Reason: To safeguard the recording and inspection of matters of archaeological importance on the site. (Policies: BE6 (RSS202); CON11 (SODCLP2011))
