Conditions / Refusal Reasons
The application site lies in a rural area where new housing development is strictly controlled with regard to Policy H6 of the South Oxfordshire Local Plan 2011 (SOLP). However, the principle of the conversion of the existing building to a residential use may be acceptable provided that all of the relevant criteria of Policy E8 of the SOLP are complied with. In relation to Criterion (vii) of Policy E8 and Policy E6 of the SOLP there is an extant planning permission for a Class B1 use of the building and the applicant has not demonstrated that this use or other non-residential uses of the building have been fully explored and found to be unacceptable in planning terms. There are no other material considerations of sufficient weight, particularly having regard to the location and appearance of the existing building, to set aside the provisions of the development plan and as such the proposal fails to accord with Policy E8 of the SOLP in particular and guidance contained within PPS4.
Visibility from the Upper Bolney lane access onto the A4155 is substandard, and the proposal to convert the barn to a large residential property would result in an intensification of use of this substandard access, which would be detrimental to highway safety, contrary to Policies E8 and T1 of the adopted South Oxfordshire Local Plan 2011.
