Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
Notwithstanding the provisions of Schedule 2 Part2 ClassA the Town and Country Planning (General Permitted Development Order) 1995 (or any Order revoking or re-enacting that Order) the gates, fences, walls or other means of enclosure approved by this permission, once implemented, shall not be altered without the prior written permission of the Local Planning Authority.
Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of local distinctiveness, pedestrian safety, protection of a public right of way and crime prevention and in accordance with Policies G6, D1, D6 and R8 of the South Oxfordshire Local Plan 2011.
The gates shall be set back a minimum of 2.0 metres from the back of the footway and shall not be made to open outwards.
Reason: In the interests of highway safety and to ensure that the gates do not obstruct the public footpath in accordance with Policies R8 and T1 of the South Oxfordshire Local Plan 2011.
The 1.8 metres high infill fencing on either site of the gate shall be of close board construction to a maximum height of 1.1 metres with open spindle or lattice construction above. Details to be submitted and agreed by the local planning authority prior to construction.
Reason: In the interests of pedestrian safety and crime prevention and in accordance with Policies D6 and R8 of the South Oxfordshire Local Plan 2011.
