Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004. Related application(s): P10/E1648/DIS

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 2274/03/B, 04B, 05A, 06A, 07D, 08A, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

Prior to the commencement of development samples of the materials to be used for the external walls and roof shall be submitted to and approved in writing by the Local Planning Authority. Reason: To ensure that the details of the development are satisfactory in accordance with Policies G2, G6, C2, H12 and D1 of the South Oxfordshire Local Plan 2011.

That the bathroom window proposed at first floor on the east elevation of the dwelling shall be glazed with obscured glass, and shall be so retained and maintained. Reason: To prevent overlooking in accordance with Policies G2, H13 and D4 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (Amendment) (No2) Order 2008 (or any Order revoking or re-enacting that Order), the enlargement, improvement or other alteration of any dwelling house and its roof as described in Schedule 2, Part 1, Classes A and B of the Order shall not be undertaken without the prior written permission of the Local Planning Authority. Reason: That control over future developments is required to ensure that the new dwelling is not excessive in size relative to the original and to protect the amenity of adjoining properties in accordance with Policies G2, G6, D1, D4, C2 and H12 of the South Oxfordshire Local Plan 2011.

That prior to the first use of the dwelling hereby permitted, the parking spaces shown on plan reference 2774/03/B and 08A shall be formed and shall be retained as such. Reason: In the interests of highway safety in accordance with Policies G2, D2, H12, T1 and T2 and Appendix 5 (Car Parking Standards) of the South Oxfordshire Local Plan 2011.

That the tree protection measures currently in place shall remain in situ for the entire course of construction works. Reason: To safeguard trees which are visually important in accordance with Policies G2, C2, C9, D1 and H12 of the South Oxfordshire Local Plan 2011.

That the evergreen trees adjacent to the dwelling along the eastern boundary shall be retained and maintained at a height of not less than 4 metres. In the event of the loss of any of these trees, the proposed bedroom window at first floor on the eastern elevation shall be fitted with obscured glass within one month of such loss, and shall be so retained and maintained, unless otherwise agreed in writing by the Local Planning Authority. Reason: To prevent overlooking in accordance with Policies G2, C2, D1, H13 and D4 of the South Oxfordshire Local Plan 2011.

The development hereby permitted shall be implemented in accordance with the scheme of mitigation/enhancement submitted with the application in all respects. Any variation shall be agreed in writing by the Local Planning Authority before such change is made. This condition will be discharged on receipt of a letter from the project ecologist stating that the mitigation has been completed according to the method statement/approval report. Reason: To protect the important species on the site, in accordance with Policies G2, C8 and H12 of the South Oxfordshire Local Plan 2011.

That the sustainable design features, as specified in the Sustainable Design Statement dated August 2010 accompanying the application, shall be incorporated into the construction and fitting of the dwelling hereby approved, and shall thereafter be retained. Reason: To ensure high standards in the efficient use of energy, water and materials in accordance with Policies G2, D8 and H12 of the South Oxfordshire Local Plan 2011.
