Conditions / Refusal Reasons
That the development be carried out strictly in accordance with the particulars of the development contained in application R3.0076/10 to seek permission for the development and the plan numbers 1022526/121/6177, /6178, /6179, /6183 and /6193 accompanying such application except as modified by conditions of this permission unless otherwise agreed by the Head of Sustainable Development in writing. Reason: To ensure the details of the development are carried out in accordance with the application as approved.

That development must be begun not later than the expiration of three years beginning with the date hereof. Reason: By virtue of the provisions of Section 91 (1) (a) of the Town and Country Planning Act, 1990.

That the hours of use of the building for pre-school use shall be between 9am and 3.30pm, Monday to Friday only. Reason: In the interests of the amenities of the neighbouring residents (CF2, E5:SODCLP2011).

That no development shall take place until the trees on the site which are to be retained and which are adjacent to or within the development area, have been protected during building operations by means of a protective fence around the edge of the canopy of the trees in accordance with B.S. 5837:2005, and with the written requirements (copy attached) of the Head of Sustainable Development relating to the protection of trees. Furthermore, no works or storing of plant or materials shall be carried out within the fenced area. Reason: To ensure the protection of trees on the land and to preserve the amenities of the locality.

Prior to the commencement of the development a Construction Travel and Management Plan (which shall include routing and all other arrangements for construction vehicles, delivery times for materials, the location of the site compound and details of how compound areas will be reinstated to their original condition) shall be submitted to and approved in writing by the Head of Sustainable Development in consultation with the Local Highway Authority. The development shall be undertaken strictly in accordance with the Construction Travel and Management Plan as approved at all times. No contractors access shall be via Ludsden Grove. Reason: In the interests of highway safety and of the safety of school users (T1, T2, T3: SODCLP2011).

Prior to the commencement of the development the external colour of the extension and a scheme for repainting the existing temporary building shall be submitted to and approved in writing by the Head of Sustainable Development. The extension and the existing temporary building shall be painted prior to its first use. Reason: In the interests of the visual amenities of the area and to ensure the creation of a pleasant environment for the development. (G2, G6, C9: SODCLP2011).

Prior to the commencement of the development the final details of the free-standing canopy shall be submitted to and approved in writing by the Head of Sustainable Development. Reason: In the interests of the visual amenities of the area and to ensure the creation of a pleasant environment for the development (G2, G6, C9: SODCLP2011).

Prior to the commencement of the development the final details of new fencing and gates shall be submitted to and approved in writing by the Head of Sustainable Development. Reason: In the interests of the visual amenities of the area and to ensure the creation of a pleasant environment for the development (G2, G6, C9: SODCLP2011).

Within six months of the use of the extension the school shall review and update the actions within their School Travel Plan using their online Travel Plan Progress Monitor. Reason: In the interests of the highway safety and to encourage more sustainable means of transport (T1, T2, T3: SODCLP2011).

That the covered cycle parking adjacent to the extension shall be retained in its current position. Reason: In the interests of highway safety and to encourage more sustainable means of transport (T1, T2, T3: SODCLP2011).
