Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

Prior to the commencement of development hereby approved samples of all materials to be used in the surfacing of the hardstanding around the perimeter of the swimming pool hereby permitted shall be submitted to and approved in writing by the Local Planning Authority. Reason: To safeguard the character and appearance of the area in accordance with Policies G2, G6, C2, CON5, CON7, D1, H13 of the South Oxfordshire Local Plan 2011.

Prior to the commencement of the development hereby approved a scheme for the landscaping of the site, involving tree planting, boundary treatment and the treatment of hard standings, shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policies G2, G6, C2, C4, C9, CON5, CON7, D1 and H13 of the South Oxfordshire Local Plan 2011.

Prior to the commencement of any site works (including demolition or site clearance) a protected area shall be designated for the trees in and adjacent to the site and the trees shall be protected in accordance with a scheme which complies with BS 5837:2005 Trees in Relation to Construction and shall have been submitted to, and approved in writing by, the Local Planning Authority. The agreed measures shall be kept in place during the entire course of development and shall include the placement of resulting spoil from the excavation of the swimming pool to avoid ground level changes around the rooting zones of any trees. Reason: To safeguard trees which are visually important in accordance with Policies G2, C2, C4, C9, CON5, CON7, D1 and H13 of the South Oxfordshire Local Plan 2011.

All plant, machinery and equipment to be used through the granting of this permission shall be so installed, maintained and operated so as to ensure that the rating noise level from the equipment does not exceed the background noise level at the boundary of the premises. Measurement and rating of noise for the purposes of this condition shall be in accordance with BS4142 (1997) - Method for rating industrial noise affecting mixed residential and industrial areas. Reasons: To protect the occupants of nearby residential properties from loss of amenity due to noise disturbance and in accordance with Policies G2, EP2 and H13 of the South Oxfordshire Local Plan 2011.

Prior to the commencement of development hereby approved, details of the means of drainage of backwash from the pool and when emptying the pool, shall be submitted and approved prior to development commencing and a scheme implemented as approved. Reasons: In the interests of groundwater protection in accordance with Policies G2, EP7 and H13 of the South Oxfordshire Local Plan 2011.
