Description
Demolition of all existing buildings, construction of access road and the erection of five, two storey dwellings with associated car ports and parking(as amended by drawing nos.09-195-SK1A and BS199-45A accompanying emails from Agent dated 26 November 2009).
Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
Prior to the commencement of development samples of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority.
Reason: To safeguard the character of the area in accordance with Policy CON7 of the South Oxfordshire Local Plan 2011.
That development shall not begin until a detailed specification of the type, design and external finish of all windows and external doors has been submitted to and approved in writing by the Local Planning Authority.
Reason: To ensure that the details of the development are satisfactory in accordance with Policy CON7 of the South Oxfordshire Local Plan 2011.
All new rainwater goods shall be painted metal.
Reason: to safeguard the character of the area in accordance with Policy CON7 of the South Oxfordshire Local Plan 2011.
That the roof lights shall be of a conservation style.
Reason: to safeguard the character of the area in accordance with Policy CON7 of the South Oxfordshire Local Plan 2011.
That raft foundations shall be used in the construction of plots 1 and 2 as detailed on drawing No. 09- 195/SK1 Aaccompanying agents email dated 26 Novemebr 2009.
Reason: To preserve archaeoloical remains in situ and to protect the scheduled ancient monument in accordance with Policies CON11 and CON12 of the adopted South Oxfordshire Local Plan.
The development hereby permitted shall not commence until surface water drainage works have been carried out in accordance with details submitted that have been submitted to and approved in writing by the Local Planning Authority.
Reason: To prevent pollution and flooding in accordance with Policies EP1, EP4 and EP6 of the South Oxfordshire Local Plan 2011.
The measures set out in section 04.09 of the design and access statement, which accompanied the application, in respect of sustainable building, shall be implemented in accordance with the statement prior to the first occupation of any unit, unless as may otherwise be agreed in writing by the Local Planning Authority.
Reason: To ensure sustainable development in accordance with Policy D8 of the adopted South Oxfordshire Local Plan.
No development shall commence until a phased contaminated land risk assessment including formulation of any necessary remediation proposals has been completed. The development shall then not be occupied until all approved remediation works are completed. All phases need to be undertaken by a person competent in contaminated land, in accordance with Defra and the Environment Agency's 'Model Procedures for the Management of Contaminated Land, CLR11' and be approved in writing by the Local Planning Authority (LPA). Consulting the LPA with proposals for each phase is recommended.
Phase 1 shall incorporate a desk study and site walk over to identify all potential contaminative uses on site and to inform the preliminary conceptual site model. If potential contamination is identified then Phase 2 shall be undertaken.
Phase 2 shall include a comprehensive intrusive investigation in order to characterise the type, nature and extent of contamination present, the risks to receptors and, where necessary, to inform the remediation strategy proposals. If significant contamination is found then Phase 3 shall be undertaken.
Phase 3 requires production of a remediation and validation scheme to ensure the site is rendered suitable for its proposed use. The remediation shall be carried out in accordance with a scheme and timetable first agreed in writing by the LPA.
Phase 4 requires a full validation report detailing the measures carried out to ensure compliance with any approved remediation scheme in Phase 3 to be submitted to and approved in writing by the LPA.
All implemented works shall be maintained in place thereafter.
Reason: To ensure that any ground, water and gas contamination is identified and adequately addressed to ensure the safety of the development, the environment and to ensure that the site is suitable for the proposed use in accordance with Policy EP8 of the South Oxfordshire Local Plan 2011.
If contamination is found to be present on the site then no further development shall be carried out until the following measures have been undertaken and approved in writing by the Local Planning Authority. An investigation into the nature and extent of the contamination in line with BS 10175: 2001 (Investigation of potentially contaminated sites - code of practice). This report should detail the works undertaken to investigate the nature and extent of the contamination and the measures proposed to remediate the site and validate the works. Following written approval by the Local Planning Authority of the remediation and validation proposals they shall be completed in full and a validation report submitted to and approved in writing by the Local Planning Authority before the development is occupied.
Reason: To ensure that any ground and water contamination is identified and adequately addressed to ensure the safety of the development, the environment and the public and ensure that the site is suitable for the proposed use in accordance with Policy EP8 of the South Oxfordshire Local Plan 2011.
No development shall take place prior to the implementation of a staged programme of archaeological work in accordance with a written scheme of investigation which has been submitted to and approved in writing by the Local Planning Authority.
Reason: To enable an appropriate level of archaeological investigation of the area including excavation and recording, post excavation analysis and the publication of results in accordance with Government advice set out in PPG16 'Archaeology and Planning' and in accordance with Policies CON11, CON13 and CON14 of the South Oxfordshire Local Plan 2011.
Prior to the commencement of the development hereby permitted a scheme for the landscaping of the site, including the planting of live trees and shrubs and the treatment of the access road and hard standings, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings.
Prior to the commencement of any site works (including demolition or site clearance) a protected area shall be designated for Japanese Pagoda tree in Crown Lane which shall be protected in accordance with a scheme which complies with BS 5837:2005 Trees in Relation to Construction and shall have been submitted to, and approved in writing by, the local planning authority. The agreed measures shall be kept in place during the entire course of development.
Reason: To safeguard trees which are visually important in accordance with Policies C9 and D1 of the South Oxfordshire Local Plan 2011.
Prior to the first occupation of the development, the parking and turning areas shall be provided in accordance with the approved plan BS199/45/A and shall be constructed, laid out, surfaced (bound material), drained and completed, and shall be retained unobstructed except for the parking of vehicles at all times.
Reason: In the interests of highway safety and in accordance with Policies T1 and T2 and Appendix 5 (Car Parking Standards) of the South Oxfordshire Local Plan 2011.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any Order revoking or re-enacting that Order) no external alterations or extensions shall be carried out to the building(s) hereby approved.
Reason: To safeguard the amenities of the occupiers of the adjoining properties and the character of the area generally in accordance with Policies G2, D1 and D4 of the South Oxfordshire Local Plan 2011.
Notwithstanding the provisions of the Town and Country (General Permitted Development Order) 1995 (or any Order revoking or re-enacting that Order), no development as specified in Schedule 2, Part 2, Class B (the formation of a means of access vehicular or pedestrian) on plots 3 or 4 shall be undertaken without the prior written permission of the Local Planning Authority.
Reason: The specific circumstances of this site warrant the Local Planning Authority having control over any further development as specified in the condition in the interests of visual amenity and in accordance with Policies CON7 of the South Oxfordshire Local Plan 2011.
In connection with the implementation of this permission no construction works shall take place outside the hours of 08:00 to 18:00 Mondays to Fridays and 8:00 to 13:00 on Saturdays. Works shall not take place at all on Sundays or Bank Holidays without the prior written approval of the Local Planning Authority.
Reason: to protect the occupants of nearby residential properties from noise and dust disturbance during the development of the site in accordance with Policies EP1 and EP2 of the South Oxfordshire Local Plan 2011.
