That the development be carried out strictly in accordance with the particulars of the development contained in the application R3.0188/09 to seek permission for the development and the plan numbers 783229/10.01/Rev B, 10.02/Rev A, 10.03/rev A, 10.04, 11.01, 11.02, 11.03, 11.04, 12.01, 12.02/Rev A, and 12.03 Rev A; Extended Phase 1 Ecological Survey (dated April 2009), Design and Access Statement (revised November 2009), and Justification Statement (dated November 2009) accompanying such application except as modified by conditions of this permission unless otherwise agreed by the Head of Sustainable Development in writing. Reason: To ensure the details of the development are carried out in accordance with the application as approved.

That development must be begun not later than the expiration of three years beginning with the date hereof. Reason: By virtue of the provisions of Section 91 (1) (a) of the Town and Country Planning Act, 1990.

That the external walls and roofs of the building(s) be constructed and finished in accordance with a Schedule of Materials and Finishes which shall first have been submitted to and approved in writing by the Head of Sustainable Development. Reason: To ensure the Materials and Finishes are Compatible with the surrounding development. (Policies: G6, D1 (SOLP2011))

That no development shall take place until the trees on the site which are to be retained and which are adjacent to or within the development area, have been protected during building operations by means of a protective fence around the edge of the canopy of the trees in accordance with B.S. 5837: 2005, and with the written requirements (copy attached) of the Head of Sustainable Development relating to the protection of trees. Furthermore, no works or storing of plant or materials shall be carried out within the fenced area. Reason: To ensure the protection of trees on the land and to preserve the amenities of the locality. (Policies G6, D1, C9 (SOLP2011))

That the land be landscaped and planted with trees (including replacement trees) and shrubs in accordance with a comprehensive planting and landscaping scheme first approved by the Head of Sustainable Development and that trees and shrubs so planted be properly maintained and that in the event of any of the trees or shrubs dying or being seriously damaged or destroyed within a period of five years from the completion of the development a new tree or shrub or equivalent number of trees or shrubs as the case may be, be planted and properly maintained in a position or positions as first approved by the Head of Sustainable Development. Reason: In the interests of the visual amenities of the area and to ensure the creation of a pleasant environment for the development. (Policies: G6, D1 (SOLP2011))

That all planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting season following the occupation of the buildings or the completion of the development, whichever is the sooner, and any trees or plants which within a period of five years die, are removed or become seriously damaged shall be replaced in the next planting season with others of similar size and species, unless the Head of Sustainable Development gives written consent to any variations. Reason: In the interests of the visual amenities of the area and to ensure the creation of a pleasant environment for the development. (Policies: G6, D1 (SOLP2011))

That the hours of operation of the children's centre for use by the public shall not allow use between 08.00 to 09.15 and 14.45 to 15.30 Mondays to Fridays during term time. Reason: In the interests of the amenities of the neighbouring residents. (Policies: G2, G6 (SOLP2011))

That the hours of use of the children's centre at other times (outside school hours) shall be submitted for agreement in writing by the Head of Sustainable Development before any use of the centre commences. Reason: In the interests of the amenities of the neighbouring residents. (Policies: G6, CF2 (SOLP2011))

That the high split level windows on the western elevation of the proposed children's centre shall be frosted or glazed with obscure glass. Reason: To ensure that the completed development does not affect the amenities of neighbouring residents. (Policies: CF2 (SOLP2011))

That prior to the commencement of the development full details of any additional proposed lighting shall be submitted to and approved in writing by the Head of Sustainable Development. Reason: In the interests of the amenities of the neighbouring residents. (Policies: CF2 (SOLP2011))

That prior to the first occupation of the children's centre building the existing School Travel Plan shall be updated (particularly for the period of construction) and shall be submitted to and approved in writing by the Head of Sustainable Development following consultation with the Travel Plans Team. The amended Travel Plan shall be put into operation before the children's centre is brought into use. Reason: In the interests of highway safety and to encourage more sustainable means of transport. (Policies: G2, CF2 (SOLP2011))

That details of a sustainable drainage system for the proposed development shall be submitted to and approved in writing by the Head of Sustainable Development prior to the commencement of the development. Any detailed scheme approved shall be implemented as part of the development. Reason: To ensure drainage details are satisfactory and to avoid pollution. (Policies: G6, CF2 (SOLP2011))

Vegetation removal should not take place during the bird breeding season, which is March - August inclusive. If any trees and/or bushes need to be removed during this time, they will need to be checked over by an ecological consultant immediately prior to removal to ensure that there are no nesting birds present. If nesting birds are present, the vegetation cannot be removed until the birds have fledged. Reason: To ensure the protection of ecological interests on the site. (Policies: G2, CF2 (SOLP2011))

If any protected species not initially surveyed for are found at any point, all work on site should cease immediately. Work should not recommence until a full survey has been carried out, a mitigation strategy prepared and licence obtained (if necessary) in discussion and with the agreement of Natural England. Reason: To ensure the protection of protected species on the site. (Policies: G2, CF2 (SOLP2011))

That the existing pond on site shall not be removed until a new pond has been created in a position to be agreed in writing by the Head of Sustainable Development. Reason: To ensure the protection of ecological interests on site. (Policies: G2, CF2 (SOLP2011))

The removal of the existing pond shall not take place except in the months of August - October inclusive. The pond shall be drained gradually and the plant material removed from it should be stacked by the side of the pond for at least 24 hours to allow any animals trapped to escape before the vegetation is removed. Reason: To ensure the protection of ecological interests on site. (Policies: G2, CF2 (SOLP2011))

Prior to the commencement of the development, details of proposals to create habitats for bats in the new buildings shall be submitted for agreement in writing by the Head of Sustainable Development. Reason: To ensure the protection of ecological interests on the site. (Policies: G2, CF2 SOLP2011))

That as construction/demolition works are planned to take place later than April 2010, the submitted protected species survey (dated April 2009) should be updated to the written approval of the Head of Sustainable Development. Reason: To ensure the protection of ecological interests on the site. (Policies: G2, CF2 (SOLP2011)).

That prior to the commencement of the development, final details of the proposals for the formation of three additional on site car parking spaces shall be submitted to and agreed in writing by the Head of Sustainable Development. The spaces shall be constructed and brought into use before the operation of the children's centre commences. Reason: In the interests of highway safety and amenity. (Policies: G6, CF2, D1 (SOLP2011))

That prior to the commencement of the development, details of a construction traffic management plan (to include details of times of delivery of materials, hours of working etc) together with a plan to manage staff travel and parking (during the construction period) shall be submitted to, and be approved in writing by, the Head of Sustainable Development. Any plan approved shall be implemented for the duration of the construction period. Reason: To minimise the impact of staff parking on the public highway in the immediate vicinity of the school in the interests of the residential amenities of neighbouring residents.
