The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004. Related application(s): P10/W0083/DIS

Prior to the commencement of development samples of the materials to be used for the external walls and roof shall be submitted to and approved in writing by the Local Planning Authority. Reason: To ensure that the details of the development are satisfactory in accordance with Policies D1 and H4 of the South Oxfordshire Local Plan 2011. Related application(s): P10/W0083/DIS

Prior to the commencement of development, a detailed plan of the parking and service area, showing surface markings and other measures to ensure delivery vehicles are not obstructed, shall be submitted to and approved by the Local Planning Authority. Reason: In the interests of highway safety and in accordance with Policies T1 and T2 and Appendix 5 (Car Parking Standards) of the South Oxfordshire Local Plan 2011. Prior to the commencement of development, the parking and service area shall be provided in accordance with condition 03 and subsequently shall be retained associated to the site, without obstruction except for the parking vehicles in the marked bays. Reason: In the interests of highway safety and convenience in accordancce with Policy T1 of the South Oxfordshire Local Plan. Related application(s): P10/W0083/DIS

During construction, access and manoeuvring to the loading bay as existing shall not be obstructed except for any works of or associated to the construction or surfacing of the parking and service area. Reason: In the interests of highway safety and to ensure the provision of off street parking in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan. No development shall take place until the Local Planning Authority are satisfied that the following measures (a-c) have been undertaken to investigate and remediate any contamination and have approved all necessary stages in writing. The site shall then not be occupied until any agreed action is implemented and approved by the Local Planning Authority. a) Completion of a desk study by a suitably qualified person. The Desk Study shall be completed in accordance with BS 10175 2001 and include a site walkover, identification of all potentially contaminative site uses and in initial conceptual model. b) If potential contamination is identified in a) then an intrusive site investigation must be completed. This investigation must be undertaken in accordance with BS 10175 and having regard to the approved desk study. A report shall be produced detailing the works undertaken to characterise the site and contain a refined conceptual model in the light of the results of the investigation. All chemical analysis shall be undertaken by MCERTS accredited laboratories. N.B. If the Local Planning Authority is not satisfied that the site has been adequately characterised after the first stage of investigation, further works will be required to clarify any remaining uncertainties. It is therefore recommended that the Local Planning Authority are consulted on the site investigation proposal before completion of the works. c) Where unacceptable levels of contamination are identified, a remediation scheme shall be produced. The scheme shall incorporate details of the procedures and documentation employed to validate the remediation. The approved remediation scheme shall then be implemented in full and the report detailing the works approved by the Local Planning Authority in writing before occupation of the site. Reason: To ensure that any ground and water contamination is identified and adequately addressed to ensure the safety of the development, the environment and the public and ensure that the site is suitable for the proposed use in accordance with Policy EP8 of the South Oxfordshire Local Plan 2011.

If contamination is found to be present on the site then no further development shall be carried out until the following measures have been undertaken and approved in writing by the Local Planning Authority. An investigation into the nature and extent of the contamination in line with BS 10175: 2001 (Investigation of potentially contaminated sites - code of practice). This report should detail the works undertaken to investigate the nature and extent of the contamination and the measures proposed to remediate the site and validate the works. Following written approval by the Local Planning Authority of the remediation and validation proposals they shall be completed in full and a validation report submitted to and approved in writing by the Local Planning Authority before the development is occupied. Reason: To ensure that any ground and water contamination is identified and adequately addressed to ensure the safety of the development, the environment and the public and ensure that the site is suitable for the proposed use in accordance with Policy EP8 of the South Oxfordshire Local Plan 2011.

The measures set out in Appendix 1 of the design statement, which accompanied the application, in respect of sustainable building, shall be implemented in accordance with the statement prior to the first occupation of any unit, unless as may otherwise be agreed in writing by the Local Planning Authority. Reason: To ensure sustainable development in accordance with Policy D8 of the adopted South Oxfordshire Local Plan.

A full archaeological watching brief shall be carried out during the period of construction works by a professionally competent archaeological organisation in accordance with details which shall have been submitted to and approved in writing by the local planning authority before development commences. The brief shall include the recording of any archaeological features revealed, limited archaeological excavation and the retrieval of artefactual evidence. Reason: To secure the protection of and proper provision for any archaeological remains in accordance with Government advice set out in PPG16 'Archaeology and Planning' and in accordance with Policies CON11, CON13 and CON14 of the South Oxfordshire Local Plan 2011.

The development shall be designed, constructed and maintained so as to ensure that the internal ambient noise levels for dwellings shall not exceed 35 dB LAeq ( 16 hour) 07:00 - 23:00 during the daytime and 30 dB LAeq ( 8 hour) 23:00 - 07:00 during the night. Reason: To protect the occupants of nearby residential properties from noise disturbance in accordance with Policy EP2 of the South Oxfordshire Local Plan 2011.

Prior to the commencement of development, a clearing and cctv survey of the foul sewer downstream of the site, to the Thames Water pumping station at the southern end of Fane Drive is carried and the results submitted to the Local Planning Authority. Reason: To prevent pollution in accordance with Policy EP1 of the South Oxfordshire Local Plan.

That the ridge height of the building hereby approved shall not exceed 0.6 m above the ridge height of the adjacent dwelling at No. 1 Chiltern Close. Reason: To ensure that the development is not unneighbourly or intrusive in accordance with Policies G2, D1, D4 and H4 of the South Oxfordshire Local Plan.
