Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the materials to be used for the external walls and roofs shall be of the same colour, type and texture as those used on the existing building(s). Reason: To ensure that the details of the development are satisfactory in accordance with Policy D1 of the South Oxfordshire Local Plan 2011.

That no waste or recycled materials shall be deposited in outside receptacles after 22:00 or before 11:00 hours on any day. Reason: To protect the amenity of adjoining properties in accordance with Policies EP2 and TSM3 of the South Oxfordshire Local Plan 2011.

That no deliveries or collections by trade vehicles shall take place at the rear of the property after 18:00 or before 11:00 between Monday to Saturday and no deliveries or collections may take place on Sundays or public holidays. Reason: To protect the amenity of adjoining properties in accordance with Policies EP2 and TSM3 of the South Oxfordshire Local Plan 2011.

That the use of the premises hereby permitted shall be restricted to between 11:00 to 23:30 hours Monday to Sunday. Reason: To protect the amenity of adjoining properties in accordance with Policies EP2 and TSM3 of the South Oxfordshire Local Plan 2011.

That the kitchen extract is installed in full accordance with the approved details (Dwg 1a and e-mail received on 17.03.09 and e-mail received on 18.03.09) and maintained in line with the manufacturer's recommendations at all times. Reason: To protect the amenity of adjoining properties in accordance with Policies EP2 and TSM3 of the South Oxfordshire Local Plan 2011.

All plant, machinery and equipment to be used by reason of the granting of this permission shall be so installed, maintained and operated so as to ensure that the rating noise level from the equipment does not exceed 35dB at the nearest residential unit. Measurement and rating of noise for the purposes of this condition shall be in accordance with BS4142 (1997) 'Method for rating industrial noise affecting mixed residential and industrial areas'. In the event of unacceptable noise or vibration being caused by the installed plant, machinery and equipment, the applicant or persons responsible shall investigate and carry out works to resolve the problem to the satisfaction of the local planning authority. Reason: To protect the occupants of nearby residential properties from loss of amenity due to noise disturbance and in accordance with Policy EP2 of the South Oxfordshire Local Plan 2011.

That no take-away delivery vehicles shall operate from the rear of the premises. Reason: To protect the occupants of nearby residential properties from loss of amenity due to noise disturbance and in accordance with Policy EP2 of the South Oxfordshire Local Plan 2011.
