Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

Prior to the commencement of development samples of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority. Reason: To safeguard the character of the area in accordance with Policies G2, G6, H12 and D1 of the South Oxfordshire Local Plan 2011.

That the dwelling and garages specified in the application to be demolished shall be demolished within two months of the first occupation of the replacement dwelling hereby permitted. Reason: To ensure satisfactory comprehensive development in accordance with Policies G2, H12 and D1 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any Order revoking or re-enacting that Order), the enlargement, improvement or other alteration of any dwellinghouse as described in Schedule 2, Part 1, Classes A and B of the Order shall not be undertaken without the prior written permission of the Local Planning Authority. Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of amenity and in accordance with Policies G2, H12 and D1 of the South Oxfordshire Local Plan 2011.

The measures set out in section 4 of the design statement, which accompanied the application, in respect of sustainable building, shall be implemented in accordance with the statement prior to the first occupation of the replacement dwelling, unless as may otherwise be agreed in writing by the Local Planning Authority. Reason: To ensure sustainable development in accordance with Policies G2 and D8 of the South Oxfordshire Local Plan 2011.

That a scheme for the landscaping of the site, including the planting of live trees and shrubs, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policies C9, G2, H12 and D1 of the South Oxfordshire Local Plan 2011.

The development hereby permitted by this planning permission shall only be carried out in accordance with the approved Flood Risk Assessment (FRA) ref: K0017/1 (Rev O) produced by Hydrologic Ltd, dated November 2008 and the Design and Access Statement, dated 03 December 2009 and the following mitigation measures detailed in the FRA: 1 Identification and provision of safe route (s) into and out of the site to an appropriate safe haven. 2 Flood-proofing measures detailed within the FRA 3 Finished floor levels are set no lower than 300m above 33.69m Ordnance Datum (AOD) 4 Flood Risk Management and management and Evacuation Plan Reason: To ensure safe access and egress from and to the site, to reduce the impact of flooding on the proposed development and future occupants and to reduce the risk of flooding to the proposed development and future occupants in accordance with PPS25.

The development hereby permitted shall not be commenced until such time as a scheme to provide details of the proposed voids / slits providing dimensions and elevations in relation to the 1 in 100 year flood level including an allowance for climate change has been submitted to, and approved in writing by the Local Planning Authority. Reason: To ensure free ingress and egress of flood flows during a flood event up to the design flood level in accordance with PPS25.

The garage and studio above hereby permitted shall only be used for purposes incidental to the enjoyment of the dwellinghouse within the application site and for no other purpose. Reason: As the separate occupation of the accommodation would represent an undesirable sub-division of the property and result in inadequate standards of amenity and privacy and in accordance with Policy H13 of the South Oxfordshire Local Plan 2011.
