Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

Prior to the commencement of development samples of all materials to be used in the external construction and finishes of the development hereby permitted, including the extended boundary wall, shall be submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the site in accordance with Policies G2, G6, C2, D1, R1, and R3 of the South Oxfordshire Local Plan 2011.

That a scheme for the landscaping of the site, including the planting of live trees and shrubs, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policies G2, G6, C2, C9, D1, R1, and R3 of the South Oxfordshire Local Plan 2011.

Prior to the commencement of any site works (including demolition or site clearance) a protected area shall be designated for all existing trees which are shown to be retained, and the trees shall be protected in accordance with a scheme which complies with BS 5837:2005 Trees in Relation to Construction and shall have been submitted to, and approved in writing by, the Local Planning Authority. The agreed measures shall be kept in place during the entire course of development Reason: To safeguard trees which are visually important in accordance with Policies C9 and D1 of the South Oxfordshire Local Plan 2011.

Prior to the commencement of development details of any external lighting to be used in the areas around the development hereby approved shall be submitted to and approved in writing by the Local Planning Authority. The external lighting shall be installed in accordance with the approved details prior to the first use of the development hereby approved. No further external lighting shall be installed without the written agreement of the Local Planning Authority. Reason: In the interests of the visual appearance of the site and the amenity of neighbouring occupiers in accordance with Policies G2, G6, C2, D1, R1, and R3 of the South Oxfordshire Local Plan 2011.

The hardsurfacing of the site shall be carried out in accordance with the details shown on drawing 09015-P01 Rev A prior to the first use of the development hereby approved. Reason: In the interests of the visual appearance of the site and the amenity of neighbouring occupiers in accordance with Policies G2, G6, C2, D1, R1, and R3 of the South Oxfordshire Local Plan 2011.

The facebond, pointing, and coping of the extended brick wall on the north and west boundaries of the site shall match these aspects of the existing north boundary wall. Reason: In the interests of the visual appearance of the site and the amenity of neighbouring occupiers in accordance with Policies G2, G6, C2, D1, R1, and R3 of the South Oxfordshire Local Plan 2011.

The development hereby approved shall not be used or occupied until foul sewerage details have been carried out in accordance with details submitted to and approved in writing by the Local Planning Authority. Reason: To prevent pollution in accordance with Policies EP1 and EP7 of the South Oxfordshire Local Plan 2011.

The development hereby approved shall not be used or occupied until surface water drainage details have been carried out in accordance with details submitted to and approved in writing by the Local Planning Authority. Reason: To prevent pollution in accordance with Policies EP1 and EP7 of the South Oxfordshire Local Plan 2011.

The measures set out in the design and access statement, which accompanied the application, in respect of sustainable building design and operation, shall be implemented in accordance with the statement prior to the first use of the development hereby approved. The sustainable design features shall thereafter be retained. Reason: To ensure high standards in the efficient use of energy, water and materials in accordance with Policies G2 and D8 of the South Oxfordshire Local Plan 2011.

Prior to the first use of the development hereby approved, the existing buildings shown to be demolished on the approved drawings shall be demolished and all resultant debris removed from the site. Reason: In the interests of the visual appearance of the site and the amenity of neighbouring occupiers in accordance with Policies G2, G6, C2, D1, R1, and R3 of the South Oxfordshire Local Plan 2011.

Cycle parking facilities shall be provided in accordance with the details shown on drawings 09015-P02 RevA and 09015-P04 prior to the first use of the development hereby approved, and shall thereafter be retained. Reason: To encourage the use of cycles as a means of transport in accordance with Policy T2 of the South Oxfordshire Local Plan 2011.

All plant, machinery and equipment to be used by reason of granting this permission shall be so installed, maintained and operated so as to ensure that the rating noise level from this equipment does not exceed the background noise level at the boundary of the premises. Measurement and rating of noise for the purposes of this condition shall be in accordance with BS4142 (1997) 'Method for rating industrial noise affecting mixed residential and industrial areas'. Reason: To protect the occupants of nearby residential properties from loss of amenity due to noise disturbance and in accordance with Policy EP2 of the South Oxfordshire Local Plan 2011.

Prior to the commencement of development full details of how the spoil arising from the development hereby approved will be removed from the site shall be submitted to and approved in writing by the Local Planning Authority. The spoil shall be disposed of in accordance with the approved details, unless otherwise agreed in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the site and the amenity of neighbouring occupiers in accordance with Policies G2, G6, C2, D1, R1, and R3 of the South Oxfordshire Local Plan 2011.
