Conditions / Refusal Reasons
That the development be carried out strictly in accordance with the particulars of the development contained in application R3.0115/09 as shown on plan numbers 781186/009/100 and photograph 2 accompanying the application except as controlled or modified by conditions of this permission, unless otherwise agreed in writing by the Head of Sustainable Development. Reason: To ensure the details of the development are carried out in accordance with the application as approved.

That development must be begun not later than the expiration of three years beginning with the date hereof. Reason: By virtue of the provisions of Section 91 (1) (a) of the Town and Country Planning Act, 1990.

That the fence approved shall be coloured dark green and the colour shall not be changed without the consent of the Head of Sustainable Development. Reason: To ensure the finish is compatible with the surrounding development. (Policies: CC6 (RSS2026); G6, D1 (SODCLP2011))

That no development shall take place until measures have been agreed and put in place to protect the trees and hedgerows along the southern boundary of the site which are to be retained and which are adjacent to or within the development area, whilst operations to erect the fence are taking place. Reason: To ensure the protection of trees on the land and to preserve the amenities of the locality. (Policies: CC6 (RSS2026); G6, G1 (SODCLP2011))
