Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
Prior to the commencement of development samples of the materials to be used for the external walls and roof shall be submitted to and approved in writing by the Local Planning Authority.
Reason: To ensure that the details of the development are satisfactory in accordance with Policy D1 of the South Oxfordshire Local Plan 2011.
That the additional living accommodation hereby permitted shall be occupied and used only in connection with and incidental to the occupation and use of The Shallows, Bolney Road, Shiplake, as a single dwelling house, as specified in the application, and shall not be occupied or used separately therefrom.
Reason: Permission is granted on the basis that the use will be ancillary to the main house as unrelated use would have an unsatisfactory relationship with the existing dwelling contrary to Policies H4 and H11 of the South Oxfordshire Local Plan 2011.
That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (Amendment) (no.2) Order 2008 (or any Order revoking and re-enacting that Order), no windows shall be inserted above ground floor level, or roof lights inserted, on the rear (south) elevation of the garage with first floor accommodation building without the prior grant of planning permission from the Local Planning Authority.
Reason: To prevent overlooking to ensure that the details of the development are satisfactory in accordance with Policies H13 and D4 of the South Oxfordshire Local Plan 2011.
That the development hereby permitted shall not be commenced until such time as a scheme to ensure that the approved garage will be of floodable design, in accordance with drawing 2662/13 rev.C, dated Jan 2009, has been submitted to and approved in writing by, the Local Planning Authority. The development shall be fully implemented and subsequently maintained, in accordance with the agreed scheme.
Reason: To ensure that the development does not increase flood risk. The proposed garage drawing, ref. 2662/13 rev.C, indicates that the voids are the height of the 1 in 100 year flood level, but the exact level is not confirmed. The condition is necessary to ensure that the voids are designed to be the height of the 1 in 100 year flood level (with an allowance for climate change), in accordance with advice contained in Planning Policy Statement 25, Development and Flood Risk Practice Guide.
Prior to the commencement of any site works (including demolition or site clearance) a protected area shall be designated for all existing trees which are shown to be retained, and the trees shall be protected in accordance with a scheme which complies with BS 5837:2005 Trees in Relation to Construction and shall have been submitted to, and approved in writing by, the local planning authority. The agreed measures shall be kept in place during the entire course of development.
Reason: To safeguard trees which are visually important in accordance with Policies C9 and D1 of the South Oxfordshire Local Plan 2011.
