Conditions / Refusal Reasons
That the development be carried out strictly in accordance with the particulars of the development contained in application R3.0084/09 as shown on plan numbers 783174.10.01, /10.02, /10.03, /10.04, 11.01, /12.01, /13.01, and 14.01 accompanying the application except as controlled or modified by conditions of this permission, unless otherwise agreed in writing by the Head of Sustainable Development. Reason: To ensure the details of the development are carried out in accordance with the application as approved.

That development must be begun not later than the expiration of three years beginning with the date hereof. Reason: By virtue of the provisions of Section 91 (1) (a) of the Town and Country Planning Act, 1990.

That samples of the external materials proposed to be used shall be submitted to and approved in writing by the Head of Sustainable Development prior to the commencement of development. Reason: To ensure the materials are compatible with the surrounding development. (Policies: CC6 (RSS2026); G6 (SODCLP2011)

That no development shall take place until the trees on the site which are to be retained and which are adjacent to or within the development area, have been protected during building operations by means of a protective fence around the edge of the canopy of the trees in accordance with B.S. 5837: 2005, and with the written requirements (copy attached) of the Head of Sustainable Development relating to the protection of trees. Furthermore, no works or storing of plant or materials shall be carried out within the fenced area. Reason: To ensure the protection of trees on the land and to preserve the amenities of the locality. (Policies CC6 (RSS2026); C9 (SODCLP2011))

As from the date of this permission no trees shall be topped, lopped or cut down and no shrubs or hedges shall be cut down without prior written consent of the Head of Sustainable Development. That the land be landscaped and planted with trees and shrubs (to include replacement trees and shrubs for those removed) in accordance with a comprehensive planting and landscaping scheme first approved by the Head of Sustainable Development, and that the trees and shrubs so planted be properly maintained and that in the event of any of the trees or shrubs dying or being seriously damaged or destroyed within a period of five years from the completion of the development a new tree or shrub or equivalent number of trees or shrubs as the case may be, be planted and properly maintained in a position or positions first approved by the Head of Sustainable Development. Reason: In the interests of the visual amenities of the area and to ensure a pleasant environment for the development. (Policies: CC6 (RSS2026); C9 (SODCLP2011)

That all planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting season following the occupation of the buildings or the completion of the development, whichever is the sooner, and any trees or plants which within a period of five years die, are removed or become seriously damaged shall be replaced in the next planting season with others of similar size and species, unless the Head of Sustainable Development gives written consent to any variations. Reason: In the interests of the visual amenities of the area and to ensure the creation of a pleasant environment for the development. (Policies: CC6 (RSS2026); C9 (SODCLP2011))

That the contractors access (including for deliveries) to the proposed development shall be via Thame Cattle Market only. On completion of the works the temporary contractors access entrance and gate shall be reinstated to its original condition. Reason: In the interests of highway safety and of the safety of school users. (Policies: T1 (RSS2026))

That a scheme for the type and location of 'No Access for Contractors Vehicles and Site Deliveries' signs to be erected at the entrance to Lusden Grove shall be approved in writing by the Head of Sustainable Development prior to the commencement of development and any scheme approved shall be implemented for the duration of the building works on site. Reason: In the interests of highway safety and of the safety of school users. (Policies: T1 (RSS2026))

That the final details (including route) and materials to be used in the construction of the contractor's access road shall be approved in writing by the Head of Sustainable Development prior to the commencement of development. That the final location of the contractor's compound, site office and parking shall be submitted and agreed (and appropriately fenced off) in writing by the Head of Sustainable Development prior to the commencement of development. On completion of the development the temporary contractor's access road and the ancillary construction works shall be removed and the playing field land shall be reinstated to a playing field to a quality at least equivalent (or better) than the current quality. That prior to the commencement of the development the final details and location of the soft play area and wall shall be submitted to and approved in writing by the Head of Sustainable Development. On the completion of the works the three temporary buildings shall be removed from the site and the land restored to a play area in accordance with a scheme to be submitted to, and approved in writing by the Head of Sustainable Development. That the scheme for dealing with the potential presence of Great Crested Newts on the site shall be as indicated in the 'Method Statement - Great Crested Newts Report - April 2009' (prepared by ecoconsult), submitted in support of this application and such strategy shall be implemented before the temporary buildings are removed from the site in consultation with the Head of Sustainable Development and the County Ecologist. Reason: To ensure the protection of protected species on the site. (Policies: NRM5 (RSS2026); C8 (SODCLP2011))

Before the occupation of the new building bat boxes and bird nesting boxes shall be installed on the building in locations and numbers to be submitted to and agreed in writing by the Head of Sustainable Development in consultation with the County Ecologist.
