Conditions / Refusal Reasons
That the development must be begun not later than the expiration of three years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the external walls and roofs shall be constructed and finished in accordance with a schedule of materials and finishes which shall first have been submitted to and approved in writing by the Local Planning Authority before development commences. Reason: To ensure that the appearance of the buildings are satisfactory in accordance with Policy G6 of the adopted South Oxfordshire Local Plan. Related application(s): P09/W0984/DIS

Before the development is first occupied the parking and manoeuvring areas shall be provided in accordance with the plan (HAN01/3/6) hereby approved and shall be constructed, laid out surfaced (bound material), drained and completed, and shall be retained unobstructed except for the parking of vehicles at all times. Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities in accordance with Policies T2 and G2 of the adopted South Oxfordshire Local Plan.

That prior to the occupation of the proposed dwellings the proposed new means of access on to The Street is to be formed, laid out to the approval of the Local Planning Authority and constructed strictly in accordance with the highway authority's specifications and that all ancillary works specified shall be undertaken. Reason: In the interests of highway safety and convenience in accordance with Policy T1 of the adopted South Oxfordshire Local Plan.

That before the proposed dwellings are first occupied the existing access on to The Street shall be permanently stopped up by the means of full face kerbing and the restatement of the verge to the approval of the Local Planning Authority in accordance with the highway authority's specifications and shall not be used by any vehicular traffic whatsoever. Reason: In the interests of highway safety and convenience in accordance with Policy T1 of the adopted South Oxfordshire Local Plan.

Prior to the commencement of any site works (including demolition or site clearance) a protected area shall be designated for the Monkey Puzzle tree, and the tree shall be protected in accordance with a scheme which complies with BS 5837:1991 Trees in Relation to Construction and shall have been submitted to, and approved in writing by, the local planning authority. The agreed measures shall be kept in place during the entire course of development Reason: To safeguard trees which are visually important in accordance with Policies C1 and C9 of the adopted South Oxfordshire Local Plan. No development shall take place until comprehensive details of proposed landscape works have been submitted to and approved in writing by the local planning authority. The details shall include specific provision for the planting of a hedge along the front boundary of the site and details of any existing features or planting to be retained; planting proposals including schedules of plants, species, sizes, numbers and densities; all hard surfaces, changes of level, means of enclosure such as walls and fencing with particulars of height, materials, brick bonds and fencing style. Reason: To help to assimilate the development into its surroundings in accordance with Policy C1 of the adopted South Oxfordshire Local Plan. Related application(s): P09/W0984/DIS

The approved landscape works shall be implemented within 12 months of the commencement of development. Except as may otherwise be agreed in writing by the local planning authority any vegetation which dies, exhibits dieback or is damaged within 5 years of implementation shall be replaced with a specimen of the same species and size. Reason: To help to assimilate the development into its surroundings in accordance with Policy G9 of the adopted South Oxfordshire Local Plan.

That notwithstanding anything contained in the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order) no additional windows shall be constructed in the walls or roof of the development hereby approved facing west on to 93 The Street and south on to The Street. Reason: To ensure that the development is not unneighbourly and to comply with Policies G2 and H13 of the adopted South Oxfordshire Local Plan.

That the first floor bathroom window shall be fixed shut and in conjunction with the first floor en-suite bathroom window shall be obscure glazed prior to the first occupation of the accommodation and shall thereafter be retained as such. Reason: To ensure that the development is not unneighbourly and to comply with Policies G2 and H13 of the adopted South Oxfordshire Local Plan.

That details of all new windows and doors shall be submitted at a scale of 1:20 and 1:5 (section and elevation) and approved in writing by the Local Planning Authority prior to the commencement of development. Reason: To safeguard the character and appearance of the area in accordance with Policies G6, H13 of the adopted South Oxfordshire Local Plan 2011. Related application(s): P09/W0984/DIS

That sustainable design features shall be incorporated into the construction and fittings of the building, details of which shall be submitted to and approved in writing by the Local Planning Authority prior to the first use of the building. The sustainable design features shall be provided in accordance with the submitted details and retained as such. Reason: To ensure high standards in the conservation and efficient use of energy in accordance with Policy D8 of the adopted South Oxfordshire Local Plan. Related application(s): P09/W0984/DIS
