Conditions / Refusal Reasons
That the development must be begun not later than the expiration of three years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That samples of the materials to be used for the external walls and roof shall be submitted to and approved in writing by the Local Planning Authority before any development commences. Reason: To ensure that the details of the development are satisfactory in accordance with Policies G6 and H12 of the adopted South Oxfordshire Local Plan 2011.

That details of the height, line, materials and finish of the replacement boundary treatment to be erected along the north-west boundary of the site shall be submitted to and approved in writing by the Local Planning Authority and shall be constructed as approved prior to the first occupation of the replacement dwelling hereby permitted. Reason: To protect the residential amenity of occupants of No.91 Old Road in accordance with Policy H12 of the adopted South Oxfordshire Local Plan 2011.

That notwithstanding anything contained in the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order) no additional windows shall be constructed in the walls of the development hereby approved facing south-east and north-west without prior permission from the Local Planning Authority. Reason: To protect the residential amenity of neighbouring properties in accordance with Policy H12 of the adopted South Oxfordshire Local Plan 2011.

That notwithstanding the provisions of Article 3 of, and Classes A, B, D and E of Part 1 of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order), no development within Classes A, B, D or E of Part 1 of Schedule 2 to the Order shall be carried out on the land unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof. Reason: To protect local amenities in accordance with Policies GB2 and H12 of the adopted South Oxfordshire Local Plan 2011.

That prior to the commencement of any site works (including demolition), a protection area shall be designated for the retained trees on the site frontage and these trees shall be protected in accordance with a scheme which complies with BS 5837:2005 Trees in Relation to Construction and shall have been submitted to, and approved in writing by, the Local Planning Authority. The agreed measures shall be kept in place during the entire course of the development. The scheme shall also include details relating to the extent of tree surgery required and a scheme for the landscaping of the site frontage to replace those trees removed during the course of development. Reason: To safeguard trees which are visually important in accordance with Policy C9 of the adopted South Oxfordshire Local Plan 2011.

That development shall not commence on site until plans detailing the slab level of the replacement dwelling hereby permitted relative to existing ground levels have been submitted to and approved in writing by the Local Planning Authority. Thereafter the dwelling shall be constructed in accordance with the approved details. Reason: To safeguard the character of the area and the amenity of neighbours in accordance with Policies GB2 and H12 of the adopted South Oxfordshire Local Plan 2011.

That, prior to the occupation of the replacement dwelling hereby permitted, the existing means of access onto Old Road shall be widened, laid out and finished to the approval of the Local Planning Authority and constructed strictly in accordance with the Highway Authority's specifications and that all ancillary works specified shall be undertaken. Reason: In the interests of highway safety and convenience in accordance with Policy T1 of the adopted South Oxfordshire Local Plan 2011.

That, prior to the first occupation of the replacement dwelling hereby permitted, the parking and manoeuvring areas shall be provided in accordance with the submitted plan (05110-P05) hereby approved and shall be constructed, laid out, surfaced (bound material), drained and completed, and shall be retained unobstructed at all times except for the parking and manoeuvring of vehicles. Reason: In the interests of highway safety and convenience in accordance with Policy T2 of the adopted South Oxfordshire Local Plan 2011.

That the garage accommodation shall be retained as such and shall not be adapted for living purposes without the prior permission of the Local Planning Authority. Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities in accordance with Policies T2, H12 and GB2 of the adopted South Oxfordshire Local Plan 2011.

That no surface water from the development shall be discharged onto the adjoining highway and a scheme to prevent this occurrence shall be submitted to and approved in writing by the Local Planning Authority and implemented prior to the commencement of building operations. Reason: In the interests of highway safety and convenience in accordance with Policy T1 of the adopted South Oxfordshire Local Plan 2011.

That the new dwelling shall be designed to incorporate sustainable methods of construction, making reference to Code Level 3 of the Code for Sustainable Homes, in accordance with details which shall first have been submitted to and approved in writing by the Local Planning Authority, prior to the commencement of the development. Reason: To ensure high standards in the conservation and efficient use of energy, water and materials, in accordance with Policy D8 of the adopted South Oxfordshire Local Plan 2011.
