Conditions / Refusal Reasons
That notwithstanding the provisions of Article 3, Schedule 2,Classes A, B, D and E of the Town and Country Planning (General Permitted Development Order) 1995 (or any Order revoking and re-enacting that Order), no extensions or any buildings within the curtilage, ancillary to the main dwellings, shall be constructed unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof. Reason: To ensure the properties are provided with an adequate area of private outdoor space in accordance with Policy D3 of the South Oxfordshire Local Plan 2011.

That notwithstanding the provisions of Article 3, Schedule 2, Class A of the Town and Country Planning (General Permitted Development Order) 1995 (or any Order revoking and re-enacting that Order), no windows at first floor level shall be inserted, altered, enlarged or improved in the south-east or north-west elevations of either dwellinghouse, unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof. Reason: To prevent overlooking and loss of privacy which would be harmful to the amenity of neighbouring residents at 123 and 135 St Helens Avenue, contrary to Policy D4 of the South Oxfordshire Local Plan 2011.

That the garage accommodation shall be retained as such and shall not be adapted for living purposes unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof. Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities in accordance with Policy T2 of the South Oxfordshire Local Plan 2011.

That the roof of the single storey element to the house erected on plot 1 (next to 123 St Helens Avenue) shall not be used as a balcony and no balustrades or any other form of enclosure shall be fixed around this flat roofed area at first floor level. Reason: To prevent the creation of a balcony area, which would be harmful to the amenity of occupiers of 123 St Helens Avenue, contrary to Policy D4 of the South Oxfordshire Local Plan 2011.

That the roof lights in the north-west and south-east elevations of the development hereby permitted shall be inserted at 1700mm above first floor level, in accordance with the approved plans, within 3 months of the date of this planning permission and shall thereafter be retained as such. Reason: To ensure the details of the development are satisfactory and to prevent unneighbourliness through overlooking in accordance with Policy D4 of the South Oxfordshire Local Plan 2011.

That the bathroom window in the south-east elevation of the development hereby permitted shall be glazed with an opaque type glass and the window shall thereafter be retained and maintained as such. Reason: To ensure the development is not unneighbourly in accordance with Policy D4 of the South Oxfordshire Local Plan 2011.
